Reps. Eric Swalwell (D-Calif.) and Dan Goldman (D-N.Y.) are planning to introduce a bill that would strip federal Immigration and Customs Enforcement (ICE) officers of their qualified immunity protections.
The bill, called the ICE OUT Act, comes amid fervent debate over whether an ICE officer should face criminal prosecution for the fatal shooting of 37-year-old Renee Nicole Macklin Good on Wednesday.
Macklin Good was shot and killed by an ICE officer in Minnesota after reportedly dropping her son off at school. Videos shared to social media showed Macklin Good’s car stopped on a snowy road when officers approached, demanding she exit the vehicle. As another masked officer attempts to open the driver’s door, the vehicle reverses. As the car accelerates and begins to turn away, a third officer who was standing in front draws his weapon and fires three shots as he steps to the side.
Senior Trump administration officials have said the officer acted in self-defense as Macklin Good attempted to use her car as a weapon. Homeland Security Secretary Kristi Noem labeled Macklin Good’s behavior an act of domestic terrorism.
But Democrats widely disputed that narrative, with many saying the shooting was unjustified and an independent investigation is needed.
“Renee Good was a mom of three kids. And if you looked at her glove compartment, which has been photographed and shared, you don’t see a weapon, you don’t see a knife, you don’t see a gun. You see what we as parents call ‘stuffies,’ stuffed animals. You see a little cup of Cheerios,” Swalwell said on an episode of “The Daily Blast” from The New Republic released Friday.
The shooting put renewed attention on the Trump administration’s immigration enforcement tactics and called into question whether the officer’s use of force violated state or federal law.
Federal law enforcement officers have broad legal protections when acting in the scope of their official duties. Still, states can bring charges under certain circumstances, including when an officer’s actions violate the law or are deemed not to be “necessary and proper” to fulfill their duties.
Vice President Vance said during the White House press briefing Thursday that the officer was “doing his job.”
“The precedent here is simple: You have a federal law enforcement official engaging in official action. That’s a federal issue. That guy’s protected by absolute immunity,” Vance added.
Goldman acknowledged on the podcast that it would be “very difficult” to prosecute the officer under the current standard, which “allows for the officer’s own view to carry a lot of weight.”
“So what this bill does is only for civil enforcement officers — not criminal enforcement officers who are dealing with real bad guys, not moms driving cars — it would say that it’s an objective test,” he continued. “And if you are acting completely outside of your duties and responsibilities, you don’t have immunity from a civil lawsuit, and you don’t have a defense from a criminal charge.”
He added that the bill would also narrow the definition of what ICE officers can do within the scope of their duties.
“Their only authority is to investigate and civilly arrest immigrants for immigration violations,” Goldman said. “And so they should have never been in the situation they were in, where they were trying to take a woman out of a car. That was not part of what they should be doing. They could ask her to move if they needed to. It doesn’t look like from the video that she was doing anything that was obstructing them.”
Minnesota Attorney General Keith Ellison (D) said shortly after the shooting Wednesday that “if anyone broke the law,” he would do everything in his power to ensure they’re “held accountable.” Hennepin County Attorney Mary Moriarty (D) said her office was “pushing hard” for a local investigation.
Asked by journalist Greg Sargent about the Department of Homeland Security’s push to recruit more officers and the large federal cash infusions into the agency, Swalwell said he “wouldn’t vote to give them a penny” in the next budget.
“We were promised that the most violent in our community would be targeted. And I can’t speak for Dan, but again, as a former prosecutor, I imagine that we all agree with that: Get violent criminals out of our community,” Swalwell said.
“That’s not what they’re doing. They’re chasing people through the fields and factories where they work. They’re going to churches, they’re going to schools, they’re terrorizing people who are here with all of their documents,” he continued.
Goldman also promised ICE would be “dramatically and overwhelmingly revamped” if Democrats take control of the House in the midterm elections.

They left out all of the meat, her purpose for being there, how and why the car was deliberately parked to block the street, how her and her wife were acting as a team to perform the blocking action, they all leave out that while attempting to open the car door she was being ordered out of the car, and that she was fleeing law enforcement, not merely leaving, and of course the fleeing car as a weapon.
I wonder if Fang Fang gave Eric Swalwell permission to do this.
