A man from El Salvador who ICE says is illegally in the country is now charged with second-degree murder for allegedly shooting and killing a man in Reston on Wednesday.
Authorities say Marvin Morales-Ortez had just been released from jail the day before the killing, which happened inside a home at 12307 Fan Shell Court in Reston.
Court records and other sources indicate Morales-Ortez was allegedly a member of the MS-13 gang.
ICE says it had put a detainer on Morales-Ortez, yet he was still released from jail by the Fairfax County Sheriff’s Office. When 7News asked why Morales-Ortez was released, a spokesperson replied by email that “a judicial warrant that would be required to hold him past the ordered release was not on file.”
Morales-Ortez was released from jail on Tuesday after prosecutors with the Fairfax County Commonwealth’s Attorney’s Office decided not to move forward with prosecuting him on charges of malicious assault and pointing/brandishing a gun stemming from an incident on September 12.
“Prosecutors were unable to move forward with the case because the victim told police that they were out of the country and would not be coming to court to cooperate in proceedings,” wrote Laura Birnbaum, a spokesperson for Fairfax County Commonwealth’s Attorney Steve Descano, in an email to 7News. “Sadly, without the victim’s necessary testimony, we could not move forward with the case.”
7News learned that the 23-year-old Morales-Ortez has been charged with crimes six other times since 2019 – including a first-degree murder charge for the death of Jose Lorenzo Guillen Mejia in 2019 – but in every case except a charge of petit larceny, prosecutors ultimately decided not to move forward in court.

Until these state/county officials and Sherifs start being arrested and jailed nothing will change. It boggles my mind that this is what people/voters want.

Descano is an evil and incompetent Commonwealth Attorney that should have been removed by the Attorney General, but that’s a lost cause now that the lying, criminal Dims won that position in the last election.
I am very nervous about the course of the commonwealth over the next four years.
There should be a Federal list of politicians, judges and their family members who are victims of rapists, robbers, etc from gangs and illegals.

I recamemry Oakton when Rt. 123 was 2-lanes and the Oak was there and Appalachian Outfitters was across the road. Outfitters was like a small town army-navy surplus store...only better.
When that site was being cleared for a shopping center, Brother, a friend and I took down a residential garage in spitting snow and transported it on a low-boy to Fairfax City. Rebuilt it the following Spring.
Purely by chance, saw the main house of old Flint Hill Academy moved 1/2 mile across Rt.123. Missed breakfast that day at Rt. 29 Diner but the old house still stands.
