Federal judge orders FEMA to restore billions in canceled disaster mitigation funding

A federal judge in Massachusetts on Thursday ordered the Trump administration to restore billions of dollars in canceled FEMA disaster mitigation funding, siding with 22 states and the District of Columbia that sued over the canceled grants this summer.

President Donald Trump’s administration said in April it was “ending” the Building Resilient Infrastructure and Communities (BRIC) program, which helped communities with predisaster projects to harden infrastructure and improve resilience against the increasing threats of climate change.

The administration called the program “wasteful and ineffective” and said it would halt $3.6 billion in funding awarded but not yet paid and would not award $882 million in grants for the following fiscal year.

The program’s disruption upended projects across hundreds of communities in both Republican- and Democratic-led states, thwarting plans to improve stormwater drainage, harden electrical lines and even help relocate households living in areas most vulnerable to disasters.

A Department of Homeland Security spokesperson told The Associated Press Thursday that DHS “has not terminated BRIC,” but did not elaborate on the program’s status.

“The Biden Administration abandoned true mitigation and used BRIC as a green new deal slush fund,” the spokesperson said, referring to a Democratic plan to combat climate change. “It’s unfortunate that an activist judge either didn’t understand that or didn’t care.”

The order comes at a time of profound uncertainty over FEMA’s future and on the same day that a long-awaited meeting of the FEMA Review Council to present a report recommending reforms to the agency was abruptly canceled by the White House because it had not been fully briefed on the latest version of the report, according to a White House official who was not authorized to discuss the matter publicly and spoke on the condition of anonymity.

Why do I see a black Robed hands in the till every time spending money we don't have is reined in?

Couldn't a legal case be made to bring before the same judges for a charge of "Check Kiting"? Writing checks for things you don't have the money for gets we, the people in jail.

Any program that has the word “communities” in it is a scam, a money laundromat, an NGO wet dream.

It’s pretty clear by now that these liberal judges don’t give a s#it about being overturned by a higher court, they just figure WTF, throw as many roadblocks in front of Trump as they can for as long as they remain in place. After all they’re not worried about losing their jobs, which when you think about it,is a pretty big weakness in our system.

No judge should serve for life. Including the Supremes.

If judges followed the Constitution, and respected the separation of powers, term limits would not be an issue. The problem is the teaching of the “living Constitution” over the past 50 years in law schools has resulted in a generation of attorneys and judges who believe they can interpret the law to be what they personally believe the law should be.

Congress appropriates funds and the president administers the funds appropriated by Congress under the Constitution. Congress also has the power to impeach and remove a president who is inappropriately spending, or not spending funds appropriated by Congress. The judge should have told the 22 states their remedy, if they perceive funds are not being appropriately administered by the president, is to appeal to Congress.

Likewise many interpretations of the Constitution, i.e. reading language into the Constitution that isn’t in the specific words written in the document, are appropriately addressed through the amendment process, not dictated by the Supreme Court. If a group feels that hand guns should be banned, they can petition the states to call a Constitutional Convention, or appeal Congress to draft, pass and send an amendment to the states for ratification. No judge or court should be approving limitations on the essential freedoms guaranteed by the Constitution.

The Constitution is not outdated. If the 3 coequal branches of government, and the bureaucracy, follow the Constitution, government is self limited. It is the desire of government to acquire more power than exists in the Constitution, over the states and citizens, that results in judicial “interpretation”, excessive use of executive orders and excessive regulations, as well as much of the gridlock in Congress.

There is State FEMA and Federal FEMA. No need for both. Calling out the National Guard is much more effective and much less political.
