Tina Peters will remain in state prison during appeal, federal judge rejects bid for release

(AP) — A federal magistrate judge on Monday rejected a bid by a former Colorado county clerk to be released from prison while she appeals her state conviction for orchestrating a data breach scheme driven by false claims about voting machine fraud in the 2020 presidential race.
Former Mesa County Clerk Tina Peters filed a federal lawsuit asking that she be released on bond while her appeal is considered. Attorneys for the state had argued the case should be thrown out partly because of a legal doctrine that prevents federal courts from getting involved in pending state criminal cases.
Federal magistrate judge Scott Varholak ruled Monday that Peters didn’t make a case that he should get involved in overturning her state sentence.
Peters argued that the magistrate judge should free her because she said the state judge who sentenced her to nine years behind bars violated her First Amendment rights. Peters claimed he punished her for making allegations about election fraud, but prosecutors argued that the U.S. Supreme Court has allowed judges to consider people’s speech during sentencings if they deem it relevant.

Yep. The State of Colorado is a Leftist fever swamp. And I say this, posting from a real, live Leftist Fever Swamp, so I know what one looks like.
People should pay for this outrage with imprisonment.
It is things like this that I read every day that reinforces to me that I am on the right side of these issues, when the people that oppose us do things like this to American citizens.
Why weren’t the Democrat election officials prosecuted for illegally deleting voting machine log files?
I used to like visiting CO for its natural beauty. Now I loathe it!
They want Ms. Peters to die in prison. She revealed obvious fraud in the 2020 election and she must be punished for that “crime”.
The judge should be removed from the bench for participating in this travesty of justice.
I hope she’s not Terri Schiavo II. Trump should send federal marshals to take her out of that prison. He can cite humanitarian reasons and fear for Mrs. Peter’s life.

I lived in Calif, in the 70s.
I was great.
I hung out in Colo. in the 80s and 90s.
Both are no longer a place to live.

There are too many Leftists everywhere weaponizing our justice system. But her lawyer will keep trying, thank goodness.
She should have stabbed someone on the light rail mobile Denver drug market train…and be black. She’d already be out without any appeal.
That said, what they are doing to Tina Peters is beyond reprehensible, it's criminal. Why the heck can't Trump get her released?

I lived in Arvada Colorado from 79-81, it was a great place to live back then.

It’s time to pull that trigger. Perhaps Trump’s Justice Department can classify her as a material witness, or something like that. But it will take a certain amount of boldness to go that route.
I would hope that Trump has that boldness.
We will remember this kindness when Tina Peters is free and Jena Griswold and Phil Weiser are in prison.
