Justice Elena Kagan emerged as an unexpected critic of New Jersey’s position Tuesday as the Supreme Court weighed whether a faith-based crisis pregnancy center may challenge a state subpoena in federal court.
Her pointed questioning suggested she may join the court’s conservatives in siding with First Choice Women’s Resource Centers, which argues that New Jersey’s investigation threatens its First Amendment rights.
Why It Matters
The case stems from a subpoena issued by Democratic Attorney General Matthew Platkin’s consumer-protection division, seeking information from First Choice—including a list of its donors—as part of a probe into whether the center misled women about the services it offers. Crisis pregnancy centers, which encourage women to carry pregnancies to term and often present themselves as offering comprehensive reproductive health counseling, have been under heightened scrutiny in Democratic-led states since the Supreme Court overturned the nationwide right to abortion in 2022.

First Choice pushed back against the subpoena, saying the investigation lacked merit and that revealing donor information could chill support for the organization. After lower courts ruled the challenge premature because the subpoena had not yet been enforced, the center appealed to the Supreme Court.

Yes. “Why it matters” should just switch to “Editiorial comment follows.” That is what they are doing. Burying an editorial in a news story.
I feel like Kagan is an intellectual and at least marginally honest. I also feel like the men on the court take her seriously. Her two ostensible ideological allies on the Court, however, are boobs and I think she recognizes that.
I think Kagan is trying to bond with Amy.
I believe a Dim “donor” told Kagan that leftist organizations don’t want their donors to be vetted thoroughly any more than this pro-life organization’s donors.
She spent a lot of time with Summers, who spent a lot of time with Epstein. I don’t think she went to the island though. Talk about wallflowers at the orgy.
Kagan may be somewhat of a disappointment to Obama.
I agree precisely with your characterization. The Wise Latina is not. Jackson may have some modicum of intelligence (or maybe not), but like tens of millions has just subsumed herself into the hive mind of the left. Kahan is smart and not infrequently rules with some measure of integrity
The left has given Kagan her marching orders. Appear sensible until the left regains power. Then go back to being fruitcake nutty.
Meanwhile, Kentaji is still trying to figure out what day it is.
Kagan is easily superior to the other two idiots, who belong behind the counter at MacDonalds.
Kagan is a legit Justice. Whatever the best legal argument is for “their” side, she’ll make it. The other two have no business on the Court.
The only one who seems to be unable to do her job is Jackson.
Kagan usually (though not always) does vote to protect religious liberty.
