Alleged gunman Luigi Mangione will be back in court Tuesday for a second day of testimony as the judge overseeing his state murder case weighs whether to throw out key evidence.

On Monday, Judge Gregory Carro heard a 911 call a McDonald’s employee in Altoona, Pennsylvania, made telling the dispatcher some customers were concerned the alleged killer of United Healthcare Chief Executive Brian Thompson, who was fatally shot in Midtown Manhattan, was in the restaurant.

Two corrections officers who work at SCI Huntingdon, the state prison where Mangione was held until he was extradited to New York to face charges, testified about alleged statements Mangione made to them, including his disclosure that he had a 3D gun in his backpack.

Mangione’s lawyers are trying to get key evidence in the case thrown out. They allege Altoona police officers illegally searched Mangione’s backpack without a warrant and failed to read him his Miranda warning before questioning him. A gun, ammunition and a notebook of Mangione’s writings were found inside his backpack, according to court documents.

Five witnesses testified on Monday. Prosecutors indicated they could call more than two dozen witnesses in total. The hearing is expected to last several days. 911 call

Before Monday, little was known about the 911 call that ultimately led to Mangione’s capture and ended a five-day nationwide manhunt after the brazen shooting.

A manager at McDonald’s placed the call at 9:14 am on December 9, 2024. Her voice was calm as she told the 911 operator that she tried to call a nonemergency number but couldn’t get through.

“I have a customer here that some other customers were suspicious of and he looks like the CEO shooter from New York,” the manager said. “So they’re really upset and they’ve come to me.”

"The manager told the dispatcher the man was sitting in the fast-food restaurant’s lobby near the bathrooms with a pharmacy bag in front of him. Let’s get ready for the sickening sight of a bunch of young liberal women professing their love and admiration for this killer, or talking about how cute he is. That died down after his arrest but it will come back with a vengeance. And there will be dozens of “think pieces” in magazines like the Atlantic about how it is justified.

I like that the legal system is careful, however, I don’t understand what purpose a trial serves when there is video evidence?

I don’t understand what purpose a trial serves when there is video evidence?

Almost all video is digital today.

Considering what can be done with video and AI today, I no longer trust video evidence.

That Luigi Mangione is still stealing oxygen a year after he was arrested for murder is prima facie evidence that the Justice system in New York is a total abomination.

And this is just the first (of probably many more) pretrial hearing.

The punk has huge family wealth behind him, he can buy his way through the legal system. By the time the lawyers are finished, he will have negotiated down to manslaughter and time served.

Cops have the right to protect themselves from weapons in a backpack. The Constitution doesn’t state or imply that cops have to arrest a person or tell him his rights before investigating a crime.

I didn't see anyone who supported him murdering that CEO

I did see comments that pointed out Mangione is just another consequence of Obamacare.

With Obamacare, Democrats turned US healthcare into a joint venture between statist/woke government and insider crony-capitalists in the insurance industry, while at the same time, their aggressive, far-left faction continues to agitate against anything that is not purely socialist.

With those contradictions the American Left has created, its a surprise only that we aren't seeing more murders and violence.

I have a feeling it is SOP for defense lawyers to try and get an arrest thrown out so that evidence from that arrest become inadmissible. I doubt even if the judge ruled in the defense’ favor that it would mean the case would not go forward. It is a delay tactic.
