EC Going to Expropriate Russian Assets in December — Kallas

Kaja Kallas said that Belgium has legitimate concerns about the risks, but the other member-states have said that they are willing to share those risks

BRUSSELS, December 1. /TASS/. The European Commission intends to make the decision on the expropriation of Russian assets at the European Council’s meeting on December 18-19, High Representative of the EU for Foreign Affairs and Security Policy Kaja Kallas told reporters.

"We are not going to leave the Council in December without the result for the financing of Ukraine," Kallas said. "Belgium has legitimate concerns about the risks, but the other member-states have said that they are willing to share those risks. So we are discussing those things, as it was said," she added.

The European Commission announced earlier that it is going to provide Ukraine with military and financial aid in 2026-2027 on account of expropriation of Russian sovereign assets under the guise of the so-called "reparation loan." The greater portion of such assets is blocked on the Euroclear platform in Belgium.

OK. But I hope the EU has the military power to back this up when Russia declares this an act of war and starts appropriating EU assets in Russia.

Elements of Trump's "peace plan" have called for $200 billion in Russian assets being used for a reconstruction fund to be funneled through US firms.

The Europeans hold the bulk of these funds, especially Euroclear in Belgium. To the Europeans (and Russia) this scheme looks like a bribe to Trump to get him to take Russia's side.

The Europeans may therefore preempt that part of the deal by confiscating the money themselves and using it to arm the Ukrainians.

I agree with you in the sense that fixing the US' internal problems is more pressing.

But that doesn't imply we have no foreign enemies, and the foreign policy problems can come back with threat of a big war, so they can't simply be ignored.

If Trump isn't careful, he'll leave the US looking like a faithless ally and a coward, and we'll wind up in exactly the same position as we were in 1940, waiting for a sucker punch.

You are correct. We DO have enemies. They are in Brussels and London.

The money is at Euroclear.

Euroclear is a privately owned bank. It is not an EU government entity. It operates under the supervision of the Bank of Belgium. It also has an ownership structure that includes “users” meaning depositors.

It is the owners who will be liable for any lawsuits that declare illegal action, and the suit will obviously not be filed in European courts. It will be anywhere Euroclear has a branch — that is all over Asia.

Confiscation of the Russian assets from Euroclear (btw mechanism for this is not defined, it is very possible Euroclear could move the assets to its Asia branches) by the EU will obviously trigger lawsuits. But somehow the EU thinks it is they who will be sued and thus if they can get member states to agree to share the liability, they can proceed.

It is not the EU that Russia would be forced to sue. It is Euroclear. Which contains other assets belonging to the other users (countries) who maintain deposits there — which would be most countries. For example, perhaps the remaining Chinese US treasury holdings.

It is not clear why Euroclear has not explicitly and publicly protected itself by loudly moving the assets to its Asian branches.

No need to hope. The EU NATO countries have enough power to take on Russia, especially now when Russia's military has been rendered a third-world military by Ukraine.

Russia is having a hard enough time taking on Ukraine, much less if they decide to declare war on Europe.
