A five-year-old girl has been ordered to keep the surname of her rapist father after a High Court judge found it formed a key part of the child's identity and heritage.
Mr Justice Peel made the ruling at an appeal in relation to a child, referred to in court as D, despite the history of serious domestic abuse.
D's mother argued that her daughter being tied to the name of a rapist was retraumatising.
The child has not seen her father - who was found to have committed four 'very serious' incidents of sexual abuse against the mother between 2015 and 2017, including rape - face-to-face since December 2021.
'Despite her saying she wanted to wait' until marriage, the court heard the father had refused to stop intercourse when the mother cried in pain and said 'no'.
He was also threatening and verbally abusive during the breakdown of the relationship.
During one argument in September 2021, the court heard the father had told the mother: 'There is no guarantee that if I come back here that I will not get so stressed out that I decide to pick up the knife, kill your parents first in their sleep and then kill you and [D].'
He was said to have left her and D living 'in fear', swearing at the mother weeks later.
Despite the findings, Judge Laura Moys, a family recorder, ruled in March that changing D's surname would 'constitute a further rupture in the link she has to her father in a way that is not justified or proportionate'.
The judge found the child's surname 'is a part of her identity and provides an important connection to her father and paternal heritage'.

The UK’s judicial system and judicial power of review has become totally unhinged, much like it has in the USA.
In fact, it would seem like the two are actually somehow connected.
The English Insane Asylum keeps hitting new lows.
Tell me again why we have a “special relationship” with them?!
I thought we settled the question back in 1776.
The UK has “public order” offenses. One of which is causing someone else distress. I’m just surprised the UK judge didn’t jail the little girl for causing her father distress.
What a disgusting place the UK has become.
Interesting that this judge believes a child of rape must respect and promote the rapist’s lineage.
This judge has secured a very hot retirement plan.
England and most of Europe are lost
The rulings from Britain, and most of western Europe just boggle my mind. I can’t fathom under what universe this would even make any sense. Purposefully l destruction of morality, decency, and common sense. And the public continues to vote for people who support this direction. Makes me sad.
We are experiencing a global temper tantrum of judges. Each believing they are Gods, and each are those sociopaths doing the bidding of evil. At what point does the trauma brought to bare on the people justify a remedy?

When I saar the title I knew right away the UK.
They have gone utterly mad.
The article is written solely from the complainants point of view. Non of the (alleged) evidence for the father’s side is presented.
We get a small bit of information.
1. There is a two year (plus) relationship.
2. There was a sufficient relationship that the chil was given the father’s last name.
3. There was intercourse where it was claimed that at some point the woman asked him to stop.
Does the adjective "high" modify the noun "court" or the noun "judge"?
Only because we don’t have “High Courts” here in America. Do you honestly believe we don’t have this sort of lunatic judges?
This is a woman judge making this ridiculous, decision.
Of all times NOT to show a modicum of empathy and perception.
I hope the Mom appeals this decision, but I have no idea how expensive it would be for her to deliver such an appeal. No word on if they have Public Defenders in England as we do here, where that appointed attorney may work for you Pro Bono (for free).
I HOPE THE MOTHER CAN ‘DISAPPEAR” WITH THE CHILD & BUILD A NEW LIFE.
Hopefully, they have appeals in the UK system.
They are NOT lunatic judges. They know exactly what they’re doing.
Sometimes, it comes to doing just that, which is, of course sad for a child to grow up w/o Grandparents and cousins nearby, but there are situations where it is a sacrifice worth taking if the Mom values herself and child as two people who are worthy of respect.
