President Donald Trump has labeled drug cartels operating in the Caribbean as “unlawful combatants” and said the U.S. is engaged in an “armed conflict,” multiple outlets reported Thursday, following recent strikes targeting alleged drug smuggling boats in the region.
The Trump administration said in a confidential notice the U.S. was engaged in an “non-international armed conflict” against the drug cartels, the Associated Press and New York Times reported, citing a person familiar with the matter and a copy of the notice, respectively.

Yeah, too bad we have to kill them in international waters. It would be good to kill all the ones in the US. Unfortunate that the constitution would get in the way.
The Constitution doesn't get in the way, LOAC and the Constitution are in sync. Which is why folks like this doing these things should be a cautionary tale for idiots who would make similar decisions here.
We don't, but they choose that for themselves. The US would arrest them(capture) but there is no legal or moral reason to do so. You might want to read up on LOAC and the Constitution before attempting sarcasm. Sarcasm is best rooted in fact, not feelings.
