Justice Barrett weighs in on Trump third-term talk

Supreme Court Justice Amy Coney Barrett has weighed in on the constitutional viability of a potential third term for President Donald Trump, telling Fox News host Bret Baier that the 22nd Amendment's two-term limit is clear and unambiguous.

When asked if the amendment was "cut and dry," Barrett responded: "Well, you know, that's what the amendment says, right? You know, after FDR had four terms, that's what that amendment says.".....

"Sometimes it's very specific. The president has to be at least 35 years old," she said. "But sometimes it's very general. We're protected from unreasonable searches and seizures. We have freedom of speech. And to have freedom of speech doesn't mean that you have only to pass out pamphlets in a town square. I mean, it means you have freedom to be on broadcast news."

When Baier pivoted to the 22nd Amendment, saying, "And the 22nd Amendment says you can only run for office for two terms," Barrett simply responded: "True."

The 22nd Amendment, ratified in 1951, explicitly states: "No person shall be elected to the office of the President more than twice." This amendment was adopted following Franklin D. Roosevelt's unprecedented four terms in office, establishing a formal limit on presidential tenure that had previously been only a tradition dating all the way back to America's first president, George Washington.

So if it's found that Trump actually won the 2020 election he was unconstitutionally elected in 2024.

I favor Ron DeSantis and would be happy with J.D. Vance.

I missed voting in the 2024 primary, but even here in Florida, it didn’t matter.

His electors were quite likely to have been elected in sufficient numbers in 2020, but Trump himself wasn’t elected in 2020.

The SCOTUS has this one correct.
He can’t be elected again.

However, if he wanted to serve another term, he could run as Vice President. Then, the POTUS could resign and he could finish his term.

A real shaddy trick would be to have a demented puppet get elected in a sham mail in ballot election after releasing a world wide biological weapon, then run the government........Oh wait....maybe that one has already happened.

If the language actually states what Varrett says, then just by running in 2024 would be unconstitutional for Trump because he “ran” in 2016 and 2020. I don’t have the whole amendment but “running” is different than “serving”. Not sure why that wasn’t included.

If I recall correctly, it was brought uo, tongue in cheek, as a potential Dem strategy to keep Trump out of office during the 2024 election or transition.

Trump needs to groom and champion a successor.

If MAGA is dependent upon him and him only, then it will fail as a political movement.

We already have a serious problem at winning elections when he's not on the ballot. This needs to be addressed and fixed soon.

Whatever this judicial branch note dame grad weirdo is blathering about to Newsweek doesn’t matter as long as the judicial branch thinks it’s better than the president and it does

Let her talk about how the judicial branch is out of control more powerful than the executive branch a judicial branch comprised of people appointed by illegitimacy and corruption

She can discuss how the congress enacted the ruling to limit the executive term while allowing themselves life time term as while they act like royalty in every way especially hobbling around capitol hill soaked in illegitimate

I remember some Congressman prepared a possible Amendment saying that no one could serve after serving two terms consecutively. If passed, Trump could run in 2028. I don’t see it passing in a timely way.
