Does this mean the President could not send in the National Guard to persuade George Wallace to eliminate segregation. My recollection is the President sent in the National Guard to enforce the law. How is this different?
Love this. I say send ALL illegals to sanctuary cities and then pull ALL fed funding ding from them. Make local RESIDENTS pay for them.
Time to change tactics. Use them to arrest the mayors, cops, and judges who are not upholding the law.
Sure he can...
“President sent in the National Guard to enforce the law...”
_____________
Nope. 101st Airborne
Double up the ICE in California, use these resources elsewhere more.
It was the 81st Airborne wasn’t it?
Terrible decision. As long as the federal troops are just providing protection to federal law enforcement doing their job, they’re not “enforcing the law”. They’re just ensuring that insurrectionists aren’t able to attack those federal officers, or destroy federal property.
Charles Beyer, the brother of Stephen Beyer.
What about Posse Comitatus?
“The Posse Comitatus Act is a United States federal law signed on June 18, 1878, by President Rutherford B. Hayes that limits the powers of the federal government in the use of federal military personnel to enforce domestic policies within the United States. Congress passed the Act as an amendment to an army appropriation bill following the end of Reconstruction and updated it in 1956, 1981 and 2021. The Act originally applied only to the United States Army, but a subsequent amendment in 1956 expanded its scope to the United States Air Force. Wikipedia”
So if a Podunk mayor or governor refuses to enforce a law he, or she doesn’t like, there is nothing that the President can do?
We are living in a lawless era, it seems. I hope the good guys win.
A muslim mayor could impose sharia, and the fedgov could not stop this?

Seems like every day judges invent law and ignore precedent for political purposes, wasting time.
Oh lookee, Judge a-hole was previously overruled for making a similar ruling. He isn’t going to let some uppity upper Court ithinf they are in charge. He is!! Full steam ahead with protecting the Rule of law and protecting “our democracy” or something.
That’s right. It was Gov. Faubus, not Gov. Wallace. Arkansas, not Alabama.
Yes, that was in 1957 when Ike sent troops to Little Rock under the Insurection Act. In 1963, President Kennedy federalized the Alabama national guard and then sent US Marshals to integrate the University of Alabama.
Judge blocks Trump from cutting money to Chicago, LA and other cities over ‘sanctuary’ policies
This case isn’t analogous legally to Eisenhower sending in the 101st to force desegregation.
Eisenhower invoked the insurrection act, which gave him the right to send in troops. Trump did not invoke the insurrection act, so this case is argued about the Posse Comitatus Act, and the constitutional authority of the president. If Trump had invoked the insurrection act, then the case would have been about whether there was an insurrection.
This case was decided wrongly, IMO, but it was judged on different terms.
