This is really a dumb ruling. It ignores precedent for political justice reasons.

Does this mean the President could not send in the National Guard to persuade George Wallace to eliminate segregation. My recollection is the President sent in the National Guard to enforce the law. How is this different?

Love this. I say send ALL illegals to sanctuary cities and then pull ALL fed funding ding from them. Make local RESIDENTS pay for them.

Terrible decision. As long as the federal troops are just providing protection to federal law enforcement doing their job, they’re not “enforcing the law”. They’re just ensuring that insurrectionists aren’t able to attack those federal officers, or destroy federal property.

Hayes that limits the powers of the federal government in the use of federal military personnel to enforce domestic policies within the United States. A few years earlier, Eisenhower sent the 101st Airborne Division ( regular army) to Little Rock to enforce school desecration. 101st was some bad ass dudes.

Oh lookee, Judge a-hole was previously overruled for making a similar ruling. He isn’t going to let some uppity upper Court ithinf they are in charge. He is!! Full steam ahead with protecting the Rule of law and protecting “our democracy” or something.

Yes, that was in 1957 when Ike sent troops to Little Rock under the Insurection Act. In 1963, President Kennedy federalized the Alabama national guard and then sent US Marshals to integrate the University of Alabama.

This case isn’t analogous legally to Eisenhower sending in the 101st to force desegregation.

Eisenhower invoked the insurrection act, which gave him the right to send in troops. Trump did not invoke the insurrection act, so this case is argued about the Posse Comitatus Act, and the constitutional authority of the president. If Trump had invoked the insurrection act, then the case would have been about whether there was an insurrection.

This case was decided wrongly, IMO, but it was judged on different terms.
