Americans from out of state still would have to pay higher tuition price
Anyone who has lived in Pennsylvania for at least 12 months “regardless of immigration status” would be eligible for in-state tuition under a new bill.
Introduced by state Rep. Greg Scott, D-Conshohocken, House Bill 1762 would include illegal immigrants among those eligible for the lower cost tuition price at public colleges and universities, Campus Reform reports. Last week, the bill was referred to the House Education Committee for consideration.
Scott described the current in-state tuition law as “exclusionary” in a co-sponsorship memo with state Rep. Johanny Cepeda-Freytiz, D-Wyomissing.
“Currently, Pennsylvania regulations require that those who have lived in the Commonwealth for at least 12 months are eligible for in-state tuition; however, there are exceptions, such as a student’s visa status, that prevent them from receiving in-state tuition,” he stated.
According to the memo, students paying the out-of-state cost can pay up to twice as much in tuition, or an average of $20,000 per year.
“Therefore, our exclusionary laws and the cost of out-of-state tuition can make it difficult for the estimated 4,000 undocumented students who graduate from Pennsylvania high schools each year to exercise their basic right to education, even if they have lived here their whole life,” Scott stated.
He said his In-State Tuition Fairness Act will allow anyone who has been a resident of Pennsylvania for at least 12 months to qualify for in-state tuition, “regardless of immigration status.”
The measure is being met with pushback by some Republicans, according to Campus Reform:
State Rep. Josh Kail, a life-long Pennsylvania resident, has expressed skepticism about the bill, especially regarding its possible application to illegal immigrants.
In comments made to Campus Reform, Kail stated that the provision would be “a detriment to the system.”
”We don’t want to offer incentives for people to break the law,” he said. “We want our immigration system to be done in the appropriate way” and “we need to know who’s coming into the country.”
But Scott said in the memo that the legislation will help remedy a “severe workforce crisis” by providing greater educational opportunities to more Pennsylvanians.
He said 24 states and the District of Colombia already have similar laws in place.
However, some of these states are now facing lawsuits.
As The College Fix recently reported, President Donald Trump and the Department of Justice have sued Texas, Kentucky, and Minnesota for giving tuition breaks to in-state illegal immigrants while charging higher rates to Americans from other states.

But actually, Not. Texas just rescinded it, under DoJ pressure and the other states that went along for awhile are now being pushed to roll it back.
The premise of Plyler v Doe in 1982 was that primary education was a “right” enshrined in state constitutions, and therefore “all persons” were entitled to it. Secondary Education - college - was specifically excluded. But sensible people understood what was going to happen: that can was just being kicked down the road. The rabid invaders and their enablers would be back.
So Shapiro can run his little Bolshevik game, and try to shove it down PA’s throat, but...it’s a bit late in history.
Where is such a "right" inscribed? I guess it's the same as a "right to abortion".

In more ways than one, our education establishment keeps giving us the finger.

Let them pass this bill. They are just asking for President Trump to wade into another 90/10 issue.

I lived in Pa from 1972 till 1978 and I’m sure glad I left it. I’ll bet it’s blue Pittsburgh and blue Philadelphia governing it because I don’t believe the folks in small towns and cites are liberal.
So, all we have to do, is show up with no ID, then fake some weird accent to sign in and sign up?
They don’t even have to pay in Oregon. The democretin powers make sure of it. They had out grants to illegals and raise tuition on US citizens.
I know a kid who went to OSU for 6 frickin’ years (changed majors once), got into the drug scene and ended up in jail. All money down the toilet!

The key question is this. What do majority Pennsylvania legal taxpayers think about helping illegal immigrants with tuition?
Article IV, Section 4: The United States shall guarantee to every State in this Union a Republican Form of Government [emphasis added], and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
Pennsylvanian taxpayers may not be getting the constitutionally guaranteed republican form of government that they are paying for as a consequence of this proposed law.
There's also a question if proposed law effectively violates the Constitution's prohibition of privileged groups.
Article I, Section. 10, Clause 1 Clause 1: No State shall [all emphases added] enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.
If you are an illegal, A criminal, you should not be entitled to an education or anything else except deportation.
If not they should sue.
That means we all pay for the illegals. That’s ok because the real money is from the Chicom students. Just water-down the degrees.
Federal law allows states to give in-state tuition rates to illegals, but if they do, they must also give those same tuition rates to out-of-state American students.
This fact is little known and blue states and RINO-led red states ignore this law.
