US appeals court grants Trump short-term win over Judge James Boasberg in immigration ruling

A U.S. appeals court agreed to pause a lower court order requiring the Trump administration to provide due process to hundreds of Venezuelan migrants deported from the U.S. to El Salvador under the 1798 Alien Enemies Act in a near-term victory for the Trump administration.

The U.S. Court of Appeals for the District of Columbia Circuit granted the Justice Department’s request for an administrative stay, putting on hold a lower court order handed down last week by U.S. District Judge James Boasberg.

Last Wednesday, Boasberg ruled that the migrants deported solely on the basis of the Alien Enemies Act immigration law did not have prior notice of their removals or the ability to challenge their removals in court, in a violation of due process.

He ordered the Trump administration to provide migrants deported under the law the opportunity to seek habeas relief, and the opportunity to challenge their alleged gang member status that the administration had pointed to as the basis for their removal.

Boasberg had given the Trump administration through Wednesday to submit to the court plans for how it would go about providing habeas relief to the plaintiffs in CECOT, the maximum security prison in El Salvador.

Trump should deport them all immediately while he can while the left takes it up the court change to try to halt it again.

Boasberg is outrageous. The Supremes ruled he had no jurisdiction. But he kept the case anyway and is trying to dictate how other judges in the required Habaeus cases rule.

He’s a monster. He’s plenty smart. He knows what he is doing. He knows its evil. He does it anyway.

John Roberts appointed the Lefty Boasberg to the FISA court which approved spying on candidate Trump in 2016.

Boasberg also let off Clinesmith who tampered with evidence presented to his court.

And Boasberg happened to be hanging around a federal courthouse on a late night Saturday when the ACLU(?) petitioned for a temporary injunction.

It has been many months since I’ve seen freepers post that we live in a Constitutional republic. Good. Because we don’t.

President Trump will be out of office when everything is settled with the judges and what can and cannot be done by the Executive Branch. By that time a Democrat may hold power again and everything will be thrown out the window and America will suck back in all of the illegals. Our government wasn’t designed to handle this.

Yep. Roberts knew what Boasberg was doing on behalf of Democrats and approved of it. Boasberg, and several judges appointed by Biden during the demented crook’s reign, should be removed from the bench.

SCOTUS should have shut down this lawfare against Trump and the Presidency on day one. Their failure to do so gave the democrats and lower courts the greenl-ight to continue.

A high-stakes federal court hearing just wrapped in California over Governor Newsom’s attempt to block President Trump from deploying the National Guard to quell unrest in Los Angeles against the Governor’s wishes.

Judge Charles Breyer did not issue a ruling from the bench but said he hopes to release a decision later today on whether to grant a preliminary injunction against Trump federalizing the Guard.

Breyer appeared skeptical at points — especially of the DOJ’s claim that Trump does not need to meet statutory requirements or be subject to judicial review when declaring a “rebellion.”
