Far-left Democratic California Governor Gavin Newsom will sue the Trump administration to stop its federalizing the National Guard to quell what President Trump is calling an insurrection in Los Angeles.

The insurrectionists attacked federal immigration and other agents, and then local police, after Immigration and Customs Enforcement (ICE) arrested illegal-alien rapists, murderers, and other criminals.

But whatever the merits of Newsom’s lawsuit, what Trump might do next — declare an insurrection — could well end it.

President Trump must invoke the Insurrection Act.

Why Trump Federalized the Guard

Trump federalized the Guard on Saturday in a memorandum to Defense Secretary Pete Hegseth and Homeland Security (DHS) counterpart Kristi Noem. Noting that rioters were in “rebellion against the authority of the Government of the United States,” he federalized 2,000 Guardsmen.

On Friday, “over 1,000 rioters surrounded a federal law enforcement building and assaulted ICE law enforcement officers, slashed tires, [and] defaced buildings … and taxpayer funded property. It took the Los Angeles Police Department (LAPD) 2 hours to respond,” DHS reported.

They noted that attacks on federal agents have increased more than 400 percent.

DHS reported the arrest of 118 illegals in the city that week, including those with the following “criminal histories”:

The courts will stop him from protecting people and property from destruction by illegal foreigners.

They will stop him from deporting people who are here illegally.
They will stop him from building a wall.
They will stop him from enacting tariffs.

They can’t stop him from dropping bombs on other countries without congressional approval.
They can’t stop him from working with Palantir to spy on us.
They couldn’t stop Biden from changing the immigration rules and actively helping to illegally import millions of immigrants.

It’s weird how the things they have constitutional authority to do, the courts can stop. And the things they don’t have constitutional authority to do, the courts can’t stop.

It’s almost as if it’s all arbitrary and they are making is all up as they go.

President Washington knew that when anti-tax rebels in Pennsylvania were refusing to pay the whiskey excise tax and tarring and feathering revenue agents, he had to act decisively to ensure respect for the new Federal government. He dusted off his old military uniform and took his small regular Army and the militias of several states to suppress the Whiskey Rebellion. Washington mainly used militias from New Jersey, Maryland, and his native Virginia, perhaps suspecting that some of the Pennsylvania troops might sympathize with the rebels.

Closer to our time, Presidents Eisenhower and Kennedy acted forcefully to ensure that Federal court orders mandating integration of public education were enforced in the face of massive resistance. In the case of the University of Mississippi, Kennedy used 30,000 Regular Army troops. He also invoked the Insurrection Act of 1806. While the Mississippi National Guard was Federalized, it was not directly used because many of the soldiers were likely pro-segregation. Had the mid-century Presidents not acted as forcefully as they did, segregation would have lingered. Additionally, Presidents Kennedy and Johnson used the FBI, despite a reportedly reluctant J. Edgar Hoover, to infiltrate violent resistance groups like the Ku Klux Klan, and sicced the IRS on these organizations just like had been done to Al Capone 30 years earlier.

President Trump is in a situation similar to those faced by his predecessors. There is a complex of left wing nonprofits, law firms, Mexican and other Latin criminal gangs, and openly Communist groups like Antifa who are insistent on preventing the enforcement of immigration laws. If the California authorities fail to control the chaos, Trump must act as decisively as Washington, Eisenhower, Kennedy, and Johnson did to assert the ability of the Federal government to enforce the laws of the land. If he blinks, America loses.

Law and Order United States Attorney for the Central District of California (which includes Los Angeles), Bill Essayli, said yesterday he will argue the case in court - Newsom is legally in the wrong.

Doesn't mean Essayli will win given the judicial climate in California.
