Jonathan Turley Says Trump Has Authority To Slap Tariffs On World

George Washington University law professor Jonathan Turley said Thursday on “The Ingraham Angle” that President Donald Trump has the authority to hit other countries with reciprocal tariffs.

A three-judge panel on the New York-based Court of International Trade ruled Wednesday that the president could not use his executive powers to impose reciprocal tariffs on imports. While discussing the ruling, Fox host Laura Ingraham told Turley that the tariffs could “withstand judicial scrutiny,” as previous tariffs from Trump’s first administration were upheld after being dragged through court.

“Correct. The fact is the administration wanted to try this approach. This was a three-point shot, and they hit the rim because the courts just don’t see it. But he has authority, and that’s one of the reasons why these negotiations are likely to go forward. Other countries are very sophisticated. They know what authority he has. They know that he can now turn, as he did in his first term, to pursue those,” Turley said.

“They’re not particularly onerous, he can really do that and make relatively fast work of it. Now, Congress may also want to be equally nimble here,” Turley added. “The important thing is that Trump has been using these tariffs like a gun to the head of these other countries, and the court just removed the bullets.”

If I read this correctly, what Turley is saying is that Trump can impose the tariffs in question (on Canada, Mexico, China, and the 10% global baseline) despite the current problematic court rulings.

He cites first-term precedents where tariffs under Section 232 or 301 were upheld, suggesting Trump could use these authorities to reinstate tariffs.

Section 232 (Trade Expansion Act of 1962) allows the President to impose tariffs if imports threaten national security (used for steel/aluminum tariffs in Trump’s first term) and Section 301 (Trade Act of 1974) permits tariffs against unfair trade practices.

It's ironic that the Democrats used to be the party of the working class. Now, after their heroes Bill Clinton and Al Gore implemented trade deals that sent our jobs out of the country and gutted the working class, they are the free traitors defending these deals.

I hope the American people can see that offshoring their jobs is what the Democrats are defending.

The Democrats are now the party of anti-Trump. If Trump announced that he sort of likes Preparation H, liver pate, and pickleball, the Dems would mount a full-media campaign to destroy them.

Bannon made a good point about judges yesterday AM.

He said the law firms just offer up their most dedicated Communists, some stealth if a GOP POTUS is in the White House.

But they are just another phalanx of the Deep State and COMINTERN Globalists.

"Oh sure I'm a connected judge with a pedigree. Sure I'll take a job that pays $267,000 TOPS if I am the Chief Justice of the SCOTUS. And goes downward to $200,000.

"I wouldn't be tempted at all to take extra money from others to supplement my income."

I am a proponent of tariffs as both a source of revenue and a mechanism for protecting domestic industries. But one of the great ironies here is that Trump’s tariff policies aren’t directly going to accomplish much in either regard. They’re too haphazard and arbitrary to do anything.

It might actually be WORSE if Trump ultimately wins these legal challenges, because trading partners have no major incentive to enter trade deals if they can be undone without any warning in the future — by either this President or another one.

Trump can blaze the trail, but Congress needs to lay the road on top to give it some degree of permanence as stability.

True. But the first step for Congress would have to be to strip the President of all these broad and arbitrary powers.

To be honest, I'm surprised any of those laws granting the President such "emergency powers" to impose tariffs ever stood up to constitutional scrutiny in the first place. Article I, Section 8 of the Constitution is very explicit in this regard:

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises ...

Judge napoliwrongo is claiming thwt only congress has authkrity to slap tariffs on because “its a tax” and their job is to regulate taxes, and he claims that they didnt have th3 authority 5o delegate that to the president

Someone yesterday said we allowed japan to tariff us because their country was so devestated after the war, to help them rebuild. Well, its 80 some odd years later and they s5ill tariff us? Not cool!

I think the breadth and scope of the tariffs runs a foul of the nondelegation doctrine, but we’ll see what happens when it hits SCOTUS.

Congress. We have a majority in both houses and trump should use them for everything. Once passed, trump can do anything. He should convert his EOs to bills and get them through congress and signed yesterday. This is for immigration, tariffs, government employee cuts, department cuts, and anything else. Most just need to be a page or two.
