Famed law professor Alan Dershowitz offers Trump path for resuming mass deportations after setbacks

Harvard Law School Professor Emeritus Alan Dershowitz said Monday on the "Just the News, No Noise" TV show that there is a way for President Donald Trump to deport thousands of illegal migrants out of the U.S., there just has to be due process.

"I think the Supreme Court is sending a clear message: you can do it," Dershowitz said . "Just do it right, and understand that due process doesn't have a singular meaning."

The Supreme Court last week blocked President Donald Trump from invoking the Alien Enemies Act to deport illegal migrants in Texas, throwing a curveball into the administration's crackdown on illegal immigration. Trump's invocation of the Act has been roundly criticized by professors at left and center-left law schools.

The higher court sent the case back to a lower appeals court to decide underlying factual questions in the case, including how much notice those targeted for removal should receive, and whether the move itself was legal.

I don’t know which is worse; the millions of illegals or the Judicial tyranny which is leading up to a constitutional crisis.

Any person who came here without permission, bypassed the legal process of coming to America, and broke the law. Therefore, they are not eligible for due process to deport them. Respect is a two-way street. If you disrespect the law to come here, you aren’t entitled to respect to ship your ass out.

What process is due for people who entered the country illegally and haven't left for years, or have overstayed their visas? If they didn't enter legally, didn't try to get a green card, what rights should they have to object to their removal? I like the idea of Trump declaring an invasion and suspending habeas corpus. I have been calling for that since before he took the oath of office.

Dershowitz was a maestro for Jeffrey Epstein’s sweetheart plea deal with the feds decades ago perhaps this is just as sweet of a charm.

Do you know why these people - for instance the convicted criminals who were stopped en route to South Sudan - are not being returned to their own countries?

That is common sense, so it won’t fly.

Worse, both Biden and Mayorkas ignore the “Take care” clause and their sworn oaths. They should be jailed for inviting and letting in 10 to 20 millions.

There’s always some rights. If you are a person there are rights. Over the years it meant going before an immigration judge which is not a real judge, it is not part of the Judiciary system. The immigration judges are executive branch, no advise and consent. The hearings are quick. Minimal appeals if any. Problem is Sleepy Joe let in millions. Trump knew the courts would give push back. If he listens to Dershowitz he will get SCOTUS on board and no more ridiculous District Judge injunctions

Maybe the judges should understand that. A finding within ICE that the "person" in question is an illegal alien should be sufficient for deportation, particularly due to the numbers involved. The Preamble to the Constitution shows that this application of "due process" does not require an Article III Court. The courts have already decided that if said alien is within 25 yards of the border, they can be deported, just as a policeman is allowed to kill in self-defense without a judge and air conditioned courtroom. Similarly, that there are so many illegals within the country, the courts cannot handle the numbers to deliver a "speedy" trial.

Hence, to me, this looks like obstruction of justice on the part of the judge.

The only way to accomplish the Voter Mandate to expel illegal aliens is for President Trump to suspend Habeus Corpus and Declare a National Emergency for Illegal Alien Invasion, and order the Military to expel them.

Otherwise, endless lawfare will fight every effort to deport.

hire 1000 immigration judges and have mass deportation hearings..10 or 20 cases a day per judge like traffic court....pro bono attorneys will get tired of working for nothing....

Probably because their own countries don't want them returned, or it's to avoid claims that they are in danger in their own country. Normally, a person being deported is put back on a plane or ship from the company that brought him/her here. There is a reason airlines check visas; they don't want to send someone home for free.

assign a judge to every single illegal raiding party and quickly give them due process right there on the spot before deporting them. Should take about 2 minutes each

Oh, I fully understand that this country was founded on the premise the we were all born with certain inalienable rights. In my lifetime, I have seen the rights of U.S. citizens shrink to nothing under an Administrative State which just finesses constitutional rights away to nothing. Conversely, certain favored classes of people have had their rights vastly expanded. Women were recognized as an oppressed minority, despite being the majority of voters. They can call the police, never sign a statement and have most any man criminally charged, if not arrested, because they are upset about something. For decades women had a national right to abort the unborn after consensual sex because they just didn't choose to be mothers. Then the homosexuals were recognized to have a right to marry each other which most every society in the world, if not all, had denied for millennia.

Now we have our judicial elites seeking to expand the rights of illegals so they can keep as many here as possible, for as long as possible. That's the game, and Trump doesn't want to play it. He is doing what he was elected to do: Deport the illegals starting with the criminals. Let him have at it. Habeas corpus should be suspended due to how many illegally came across the border. It is an invasion if POTUS calls it an invasion. That isn't subject to appeal.

The process that is due does not have to be that of a full criminal trial. But there needs to be some opportunity for the person to show that he is legally here, or that the government has the wrong Jose Garcia. If there has already been a criminal conviction, order of deportation, or failure to appear in court, there should not be much due process involved before deportation. (I don’t presume that liberal judges would agree with me, however.)

The question are you here lawfully does need to get asked. An opportunity to present proof thereof must be offered.

That can be done by questionaire.

I’m here in Tijuana. I saw three gringos today.

The Mexicans have been very nice with just one exception.

I have no substantial fear for my safety here.

Dental work is 40% to 60% of the US price.

Most things are more expensive in Mexico.

Most Mexican adults drive cars similar to those of the US.

If an illegal can’t drive in the USA, that’s strong motive to self-deport.

Asylum seekers need not be allowed to drive.
