D.C. needs an independent U.S. attorney

Decades before Jeanine Pirro became a co-host of Fox News’s “The Five,” cable’s highest-rated news show, she was a respected prosecutor, county court judge and then district attorney in New York’s Westchester County. This makes her better qualified to serve as the interim U.S. attorney for the District of Columbia than Ed Martin, whose nomination President Donald Trump withdrew last week following opposition from Republicans on Capitol Hill.

But since Pirro left her last job as a prosecutor two decades ago, she has acted in ways that call into question whether she has the independence necessary to responsibly take on one of the most important prosecutorial jobs in the United States. What’s more, in choosing her, Trump is pushing the limits of his authority. It isn’t clear that the law allows him to name successive interim U.S. attorneys who are not confirmed by the Senate. Both these questions need to be resolved quickly to protect D.C.'s interests.

Martin faced criticism during his four months on the job for describing himself as “Trump’s lawyer.” In fact, a U.S. attorney represents the people. He or she takes an oath to uphold the Constitution, not to protect the president. Maintaining the rule of law sometimes requires, for example, prosecuting the president’s friends or supporters.

The U.S. attorney for the capital, in particular, has a big and important job. The person supervises more than 350 prosecutors who handle all local and federal crimes in the city. (The D.C. attorney general, elected by city voters, prosecutes only juvenile crimes and certain adult misdemeanors.)

Trump has long wanted to place Pirro in a high government position. Eight years ago, he interviewed her for a top job at the Justice Department, but then-Attorney General Jeff Sessions...

Of what would this “independent” US attorney be independent?

Or, to put it another way, what branch of the US government would this attorney belong to? And how is the power of that branch expressed?

This “independent” justice department theory was already used to remove a President. I suppose that was better than a Mannlicher-Carcano rifle, but not a lot.

It’s not going to work this time.

The CIA must be nervous if it is having its office paper publish this screed.

It fears the prosecution.

I think venue for suits against Washington gubmint officials should be held in a random federal venue that changes every year.

A jury in rural Tennessee needs to be the place, then Texas, etc.

Do not all US Attorneys serve at the pleasure of the current president? He can hire and fire at his whim, and it is customary for incoming admins to clean house of all the US Attorneys from the previous admin. So.... why do we need this now?!
