A federal judge in Pennsylvania on Tuesday became the first to say President Trump can invoke the Alien Enemies Act to deport Tren de Aragua gang members.

US District Judge Stephanie Haines, a Trump appointee, said President Trump’s description of the Venezuelan gang’s “incursion” into the US meets the threshold to invoke the Alien Enemies Act.

“Having done its job, the Court now leaves it to the Political Branches of the government, and ultimately to the people who elect those individuals, to decide whether the laws and those executing them continue to reflect their will,” the judge wrote.

The judge said in her 43-page ruling that the Trump Administration must provide detainees subject to removal under AEA a 21 days’ notice and “opportunity to be heard.”

Bull$hit! Why are giving enemy terrorist 21 days notice and the opportunity to be heard? Let them talk into a tin cup. /spit

Ship them out on Frontier or Ryanair. No extra baggage fees, you know.

I think they can finesse that one. After all, these individuals came in with zero documentation other than their prison/gang tatts. They labelled themselves as gang members. Prove you are not. (gavel bangs) Deport!

We the People demand reciprocity!
TdA terrorists must give the local police 21 days notice of any violent attack against the citizens, whether planned or spontaneous.
The targets have the opportunity to be heard in that 21 days.

Ruling is correct except...does anyone doubt the past shenanigans by the national socialist judges prove beyond a doubt that the judicial system is no longer a reliable arbitration of honest interpretation of established laws.

At least this judge understands it.

Put them in a bus for 21 days and testify through metal screened windows.
Then ship em.

21 days notice

Soooooo.... The LARGE El Salvador prison could build a "21 Day Waiting Wing." On day 22, they get to join their comrades

Nice of him to give the President of the United States his permission.

In an astonishing display of hubris, the Chief Justice of the US Supreme Court has proclaimed that the Judiciary has the authority to nullify actions of the other two "co-equal" branches of the Government, viz. the Executive and the Legislative branches, which is an assumed authority of course.

“The judiciary...(has)...the authority to...strike down, obviously, acts of Congress or acts of the president”
Supreme Court Justice John Roberts
https://www.cnn.com/2025/05/07/politics/john-roberts-event-judicial-independence

Of course, logic commands that two of the co-equal branches have the authority to nullify the third, but one does not have the authority to nullify the other two.

The judge probably thought, why not? Trump is going to take away my power if I don’t.

I’ve wondered why Trump’s DOJ doesn’t have a strategy of finding district court judges to rule in favor of his policies so he can use that to ignore the district court judges that rule against him.
