As to the idea that nothing had changed with legal charges or official legal actions, so Abrego Garcia was without warning that his status had changed....

MS-13 was declared by the US govt to be a terrorist organization. From that point on, he knew he was considered a terrorist by the US government.

And the US govt had advised all illegal immigrants to self-deport or they will be deported by force. He also knew that he came here illegally and was only previously allowed to stay BECAUSE HE WAS MS-13 and would be targeted in El Salvador by a rival gang. There are only certain things that are cause for a withholding of deportation to a specific country: race, religion, nationality, membership in a particular social group, or political opinion. (found at b/(3)(A) at https://www.law.cornell.edu/uscode/text/8/1231 ). Of those, the only one which applies to Abrego Garcia is “membership in a particular social group”. IOW, in applying for a withholding Abrego Garcia was admitting that he was a member of a particular social group (MS-13) which would put his life or freedom in danger in El Salvador.

So he had DOUBLE warnings that told him there was a new sheriff in town and he was NOT going to be allowed to continue as always. He may not have known that immigration law says US SAFETY COMES FIRST, but he had Trump telling the whole world that very loudly and clearly from Day One. Being a member of MS-13 may have given him permission to live here under Joe Biden and Alejandro Mayorkas, but that very same reason became reason for him to NOT be allowed to live here once MS-13 was designated as a terrorist organization. Once he was known to be a danger here he was deportable to ANY COUNTRY INCLUDING ONE WHERE HE WOULD BE IN DANGER.

lol. We never know who we’re talking to, do we?

I just wonder if these judges have ever actually read the immigration laws. Or if they know anything about reciprocal agreements between the US and other countries involving extradition or cooperation involving transnational gangs, traffickers, and cartels.

It seems to me that if the judges want Abrego Garcia brought to the US they are going to have to order the DOJ to file some kind of charges against Abrego Garcia so they can request extradition (after he receives due process and serves any sentence in El Salvador, of course). And if they’re going to require the Trump administration to constantly report on what is being done until he serves his sentence in El Salvador that’s going to be a lot of spam clogging up those judges’ inboxes for a very long time.

But it really bothers me that these judges are able to imply in their rulings that an innocent man was denied due process because he was just snapped up and thrown in a foreign prison. That is an extremely inaccurate description, and I believe it is actually perjury since it is in a legal record. Do these judges think we need to notify every person who has a deportation order that we’re actually going to obey immigration law now - a really bizarre new thing that they should never have expected to ever happen? Send certified mail to every illegal in the country saying that if you are a danger to the US you will be sent back to whatever hellhole you crawled out of? I know there’s a ruling that says that ignorance of the law is not a defense. That’s why you can indict a ham sandwich. Most of us break some law every day and don’t even know it. Is it up to us to make sure that every gangbanger knows that if they are a danger to the US no withholding can prevent them from being deported? It’s right there in the laws already, for pete’s sake.

And this really isn’t about Abrego Garcia. It is about all the others who are here illegally who wonder whether a US President can actually enforce the existing law, and whether the black robes can excuse them all for not taking it seriously when Tom Homan says, “Self-deport or we’re coming after you” or when Trump declares MS-13, Tren de Aragua, and the cartels as terrorist organizations that we will take every bit as seriously as Al Qaeda.

Exactly what are these judges trying to tell all those illegals? That as long as they don’t get a personal warning addressed specifically to them in a court case they can be as dangerous as they want and get away with it?

To my thinking, that would be treason, if that’s what they’re trying to say. Literally giving material aid and comfort to the enemies of the United States of America.

If they’re going to talk about due process, they have to look at the WHOLE SYSTEM of due process, which includes immigration judges who routinely find people deportable because they have entered the country illegally without filing for asylum. If you don’t qualify for asylum, get in line to come here legally. THAT is due process.
