Newly released security camera footage has disproven a mother's claim that a man tried to snatch her two-year-old son while at a Walmart in Georgia, according to the accused's attorney.
Caroline Miller was shopping with her son, Jude, and her four-year-old daughter inside the Walmart in Acworth last month when she alleged that 56-year-old Mahendra Patel tried to distract her by asking where to find Tylenol and used the moment to kidnap her son.
He was arrested three days after the incident and has been held at Cobb County Jail for nearly a month, facing charges of attempted kidnapping, assault and battery.
However, Patel's attorney, Ashleigh Merchant, shared surveillance video she claims 'proves her client is innocent', describing him as a 'friendly older gentleman' simply buying Tylenol for his elderly mother.
'He's being friendly. This is a friendly older gentleman trying to help people, asking for help at the Walmart,' Merchant told WSB-TV Atlanta 2 News.
'This kidnapping of a minor bell was rung,' she added. 'Once that bell is rung, it's really hard to unring it. It's really hard to get that back and get a bond.'
On March 18, while finishing up her shopping at the large retailer, Miller was navigating the aisles on a motorized scooter - her daughter situated at her feet and her son seated in her lap - when the device broke down in the pharmacy aisle.
It was at that moment, she claimed, that Patel approached her and her children, asking for help finding the pain medication.
When Miller momentarily released one arm from around Jude, she alleged that Patel tried to take advantage of the moment and attempted to grab her son from her lap.

ASLEIGH MERCHANT IS ONE HELL OF AN ATTORNEY! She’s the one who Exposed big fat Fani!
I believe the big question is why the man was held in jail FOR A MONTH, when there was video showing that the incident never happened.
Lucky for him, he has a good attorney.
The woman should be charged with filing a false report.
Ditto! Why?
He needs to sue her for everything she has got.
From the story:
“ Speaking about the incident last month, Miller clarified that she is not handicapped but was using the motorized scooter because her children wanted to ride in it.
That detail appeared to be evident in the surveillance footage, as Miller was seen aggressively backing into shelves and laughing it off.
At one point, Miller even appeared to run over her four-year-old daughter’s foot with one of the device’s wheels, prompting another shopper to rush over and help free the child.”
I hope she ends up buying Mr. Patel a nice, new house and car.
Bizarre the cops would not look at the footage right away. He spent a month in the slammer, 10 months for here.
Not only should she be held liable to him for lost income, pain, suffering, and damaged reputation, but she should also be charged with making false statements, with a punishment equal to the worst he could have gotten if convicted of child kidnapping and everything else she was trying to get him for, with all such sentences served consecutively.
Reminds me of the Kyle Rittenhouse case in Kenosha.
The prosecutors were in such a rush to prosecute, they did not look at the video footage before arresting him and filing charges.
Walmart video is of some of the best quality surveillance in the world. Very high resolution.
Video stated the only reason she was using the motorized scooter is because the kids wanted to ride it.
“...was using the motorized scooter because her children wanted to ride in it.”
“ASLEIGH MERCHANT IS ONE HELL OF AN ATTORNEY!”
Right, which is why you shouldn’t be highly skeptical of anything she says. She is paid to get her client off. She isn’t a detective looking to expose the truth.
I would not be surprised if she is trying to cover up an alcohol problem.
somehow I doubt miller has anything to be sued over
She’s ready for her mugshot Mr DeMille.
Her face looks weird, too much Bondo make up ?
One can be locked up for a month over an accusation where video exists to show whether or not probable cause exists?
Yeah. Civil liberties ain’t what they used to be.
You mean SHOULD. I think she’s an honest lawyer.
OMG!!! She ISN’T HANDICAPPED??? She’s a LIAR ALL THE WAY!!
