Trump admin won’t be held in contempt over refusal to return wrongly deported alleged MS-13 member Kilmar Abrego Garcia — as judge warns against ‘gamesmanship’

A federal judge who ordered the Trump administration to return an alleged MS-13 gang member wrongly deported to El Salvador last month ruled that she would not hold any government officials in contempt for violating her order — for now — but warned against further “gamesmanship.”

US District Judge Paula Xinis said that the federal government failed to provide evidence detailing their efforts to return Kilmar Abrego Garcia back to the United States by April 7 after he was shipped off to El Salvador’s hellhole lockup CECOT.

“There will be no tolerance for gamesmanship or grandstanding,” she said at a hearing in her Greenbelt, Maryland, courtroom.

“To date, what the record shows is that nothing has been done. Nothing.”

Xinis called Tuesday’s hearing to question Justice Department lawyers over its disregard of court orders – including one from the US Supreme Court — to return Abrego Garcia, who was deported on March 15, against an order granting him asylum in the US.

The White House has disavowed Abrego Garcia as being “wrongly deported” despite admitting he was booted from the country as a result of a “clerical error.”

Abrego Garcia — who had been living in the Old Line State — was sent to his home country last month by the Trump administration, alongside 260 other reputed gang members under the 18th-century Alien Enemies Act.

The USSC said ‘facilitate’ so trump offered a plane ride if Bukele released the ‘maryland man’. That satisfies the courts ruling. The Salvadorian president then declined to release a Salvadorian citizen from a Salvadorian prison. If released, they said, he will be in danger of being attacked by rival gangs.

So the ‘maryland man’ who is definitely not a gang member is in danger of being attacked by rival gangs. It will be fun watching the media try to make this case.

The propaganda press’s latest manufactured sob story isn’t just another hit piece targeting President Donald Trump — it’s part of a manufactured, strategic campaign to guilt Americans out of supporting immigration enforcement and delegitimize the very concept of national borders.

Last month the Trump administration deported Kilmar Abrego Garcia, an illegal alien and alleged MS-13 gang member from El Salvador — to a prison in El Salvador.

Abrego Garcia crossed the border illegally in 2011 and was detained in March of 2019. He was charged with removability and was later denied bond when an immigration judge concluded that evidence “show[ed] [Abrego Garcia] is a verified member of MS-13” and found that he failed to prove “that his release from custody would not pose a danger to others.” As explained by Will Chamberlain, senior counsel at the Article 3 Project, Abrego filed an asylum claim six months later. In turn, a judge ruled Abrego Garcia could not be deported to El Salvador. As Chamberlain explained, “Any third country would be sufficient.”

Following legal challenges, “The Supreme Court on Thursday upheld a lower court’s decision to facilitate the return of Abrego Garcia from an El Salvador prison,” as reported by Fox News.

El Salvador’s president, Nayib Bukele, said he had no plans to send Garcia back to the United States. “How can I smuggle a terrorist into the United States?” Bukele told reporters on Monday. “I don’t have the power to return him to the United States.”

But reading the headlines from the left-wing media, one would think the administration snatched a soccer dad off the streets of Baltimore.

No. Someone (possibly a clerk) pointed out she has no jurisdiction in El Salvador. The man she wants returned is an El Salvadoran citizen, now residing in El Salvador, and there is a term for forcibly removing a citizen from another country from that country against the wishes of that government: Act of War.

The root of the problem is the asylum process, which allows fence jumpers and criminals to delay deportation just by requesting asylum. We need to end asylum altogether, cap it, or drastically limit claimants’ procedural rights — even if some goods guys are kept out along with the undesirables.

The word, “rival”, is key here. I have read this before, and I’ve rarely seen it mentioned.

Also, he’s had an Order Of Deportation active since 2019 due to his ILLEGAL status. And two American courts have made the decision that he is MS-14.

He’s home; he needs to stay there. Bukele is excellent.
