The federal judge who blocked the Trump administration's use of a 1798 wartime law to immediately deport Venezuelan nationals canceled a planned Tuesday court hearing to review the case after the Supreme Court handed a win to the president.
In a minute order published Tuesday morning, U.S. District Judge James Boasberg announced that the previously scheduled Tuesday afternoon hearing would be vacated in light of the high court's ruling – which determined, among other things, that the "appropriate venue for such proceedings is the Southern District of Texas," or wherever plaintiffs that are subject to potential removal are currently held.
The 5-4 Supreme Court ruling established due process protections for migrants, including the right to appear in court before they are deported.
Boasberg ordered that plaintiffs in the case must file a notice by April 16 indicating whether they believe that they still have a basis to proceed on their motion for preliminary injunction in the D.C. Court.

That’s exactly what popped into my mind.
a) this is not a normal, convoluted, immigration law case. The 1798 law can be applied without all the falderol.
b) that leaves only habeus corpus petitions, which are more difficult to grant;
c) habeus corpus petitions must be submitted in the jurisdiction where the person is held. Not the Trump-hating, Communist filled DC Circuit.
One consequence I'm uncertain of is that this decision appears to void Boasberg's authority completely, so until a habeus corpus petition is filed, the gov can deport, making the petition moot.
When are we going to get a case in front of the Supreme Court that simply says “District judges do not have the power to tell the president what to do.”

Thanks for the listing. If Trump get some solid citizens in the open slots Trump appointed judges will be the majority.
Two things here I believe.
One Roberts does not want to deal with this and is dragging his feet because he knows the law.
Two, Trump's people are allowing these unconstitutional acts by district judges to pile up until it is so egregious that the court has no choice but to make a proper blanket ruling against them & stop this entirely.
Has to think up something else to go after Trump with ?

The way I view all these cases is they fall into three main categories:
—Illegal immigration
—Government funding—grants, contracts etc.
—Government employees
Imho we need three separate Supreme Court cases—one for each category—hopefully saying:
—The President can deport illegal aliens using any process he wishes
—The President can stop any federal funding for any line item any times he wishes
—The President can fire any federal employee any time he wishes
Generally SCOTUS writes decisions in the manner that increases SCOTUS' Power over the other two "co-equal" branches of the Federal Government.
