Judge Boasberg Is Laying a Contempt Trap for Trump Officials

Far-left U.S. District Judge James Boasberg questioned Trump administration attorneys bitterly on Thursday over whether they violated a court order blocking deportations under a wartime immigration statute, thereby raising the possibility of contempt proceedings.

Boasberg is opposed to the administration’s use of the 1798 Alien Enemies Act to deport Venezuelans, including suspected members of the violent Tren de Aragua gang.

Boasberg is investigating whether there is sufficient evidence to pursue contempt, allowing him to imprison Trump officials. He’s laying a contempt trap.

During the hearing, Boasberg repeatedly pressed Ensign for details on who within the Trump administration had knowledge of the deportation flights and when exactly the three planes departed U.S. soil for El Salvador, Fox reported. On that day, at least 261 migrants were deported, including over 100 Venezuelan nationals removed “solely on the basis” of the law that the court had temporarily blocked.

Government attorneys won’t give details.

Why does Boasberg even have jurisdiction? He has jurisdiction only in his own mind.

Margot Cleveland of The Federalist writes:

Yesterday Trump Administration filed a reply in SCOTUS in Alien Enemies Act case. This paragraph sums up the point I’ve been stressing: Judge Boasberg so wanted to stop removal that he bypassed question of whether he had jurisdiction.

There are many difficult legal questions with no precedent regarding the Alien Enemies Act, but you can’t ignore jurisdiction because you really, really, really want to stop something you believe is bad…either at the start of the case or mid-flight!

Congress also has political question to answer: Does it want to amend the Alien Enemies Act to require process beyond habeas? To limit President’s authority? To define undefined terms?

SCOTUS could save a lot of wasted time by granting motion and vacating order. I debate whether SCOTUS has authority to enter delay impact of its ruling by some procedure to allow time for habeas filing in Texas, but Plaintiff’s attorneys are gambling by not filing there.

When Ensign responded that he believed the Trump administration did comply with Boasberg’s order, the judge shot back: “It seems to me there’s a fair likelihood that that is not correct, in fact that the government acted in bad faith throughout that day.”

Resolution to Remove Boasberg

Andy Biggs introduced a resolution on March 31, 2025, to remove Judge James Boasberg from the federal bench. He accuses him of “activist” rulings, like those against Trump’s deportation policies, that violate the “good behavior” standard for judges under the Constitution. We need 218 in the House and 51 in the Senate.

If only enough Republicans would sign up. I doubt they will:

This judge is overstepping his judicial powers. The legal system will not survive this abuse. The Supreme Court needs to step in and stop this.

Judge Boastberg is stonewalling and taking his sweet time with this case, because he knows as soon as he makes a decision, it will be appealed and the circuit court will tell him he's not an air traffic controller.

The “United States Alien Terrorist Removal Court”, not Boasberg.

All three judges on the court were appointed by Pres. GW Bush...no so sure that’s a good thing. There are two additional open positions...there has never been a case made to this court

Wonderin why AG Bondi didn’t file to have this remanded to the Alien Terrorist Removal Court...
It would probably delay anything Boasberg can do until it hits SCOTUS.

I’m beginning to believe the groundwork for using the judiciary in a political manner was planned and coordinated a long time ago. There are too many populist, anti-globalist politicians and parties targeted by judiciaries in various countries.

Georgescu In Romania, Bolsonaro in Brazil, Khan in Pakistan, Trump in the US, LePen in France, the AfD in Germany.

This cannot be mere coincidence.

The good ol’ Supreme Court justices can choose: wimp out and let absurdly pompous narcissistic woke judges think they can rule higher than Congress or the President, and watch civil war break out, or they can rule against the judges.

Nope... there would be an immediate pardon. Furthermore, there would be no conviction without Trump’s DOJ prosecuting someone.

These judges are trying really hard to bring back Venezuelan gang members. Maybe they are going to be deputized by the court as bailiffs to arrest Trump and his cabinet .

Right now? Nothing.

But under Gavin Newsom's Administration, the "crimes" by Trump officials can be tried in court.

Kinda like 1/6.

Another option would be for the Supremes to refuse to hear the appeal, have the Republicans appeal to a friendly federal judge, get a ruling in their favor, and wave it in the face of Boasberg. Note that this would cause absolute chaos in the courts if the Supremes decided to not hear the case at this point. And the chaos would lie directly at the feet of Roberts et. al.

First thing Trump should do is revoke Boesberg’s security clearance. Once that is done Boesberg cannot be on the FISA court. The second thing Trump should do is by all of the houses around Boesberg’s house and then rent them to MS-13.
