I’m not as expert on this law as a sophomore college law student so I have no business ‘interpreting’ how the Constitution applies in this situation, and my personal wishes are irrelevant.

I believe the premise behind the law is that these people are not immigrants. They are belligerent combatants, not unlike Germans or Japanese would have been during WWII. The idea that they would be entitled to due process or protected by the Bill of Rights is absurd.

I believe the premise behind the law is that these people are not immigrants. They are belligerent combatants, not unlike Germans or Japanese would have been during WWII.I assume that the question has to do with due process. To make sure that we didn't end up sending an American citizen to Bukele's prison by accident.

And neither are illegal aliens in the US. Obviously.

I’d guess it depends on the the right. If something in the BOR or the Constitution refers to the right of a ‘Citizen’, it doesn’t apply to illegals.
But I don’t think most of the documents do; they refer to ‘person’, ‘persons’ or ‘people’.
I guess it’s a question for the Supremes.
