Has anyone who opposes Trump's dismantling of the Department of Education actually read its founding documents?

From the Department of Education Organization Act: "The establishment of the Department of Education shall NOT increase the authority of the Federal Government over education or diminish the responsibility for education, which is reserved to the States and the local school systems and other instrumentalities of the States."

"It is the intention of the Congress in the establishment of the Department to PROTECT the rights of State and local governments and public and private educational institutions...and improve the control of such governments and institutions over their own educational programs and policies."

By stripping the Department of its power, Trump is UPHOLDING the will of Congress, not defying it.

Secretary of Education Linda McMahon released the following statement following President Trump’s Executive Order to return education to the states:

“Today’s Executive Order is a history-making action by President Trump to free future generations of American students and forge opportunities for their success. We are sending education back to the states where it so rightly belongs.

“Education is fundamentally a state responsibility. Instead of filtering resources through layers of federal red tape, we will empower states to take charge and advocate for and implement what is best for students, families, and educators in their communities.

“Closing the Department does not mean cutting off funds from those who depend on them—we will continue to support K-12 students, students with special needs, college student borrowers, and others who rely on essential programs. We’re going to follow the law and eliminate the bureaucracy responsibly by working through Congress to ensure a lawful and orderly transition.

“With today’s action, we take a significant step forward to give parents and states control over their children’s education. Teachers will be unshackled from burdensome regulations and paperwork, empowering them to get back to teaching basic subjects. Taxpayers will no longer be burdened with tens of billions of dollars of waste on progressive social experiments and obsolete programs. K-12 and college students will be relieved of the drudgery caused by administrative burdens—and positioned to achieve success in a future career they love.”

President Trump cannot fully dismantle the Department of Education with an executive order alone.
Congress must pass
@RepThomasMassie’s bill (H.R.
899) to abolish it. An EO can weaken the department, but legislation is required to eliminate it.
The bill needs 60 Senate votes or 51 through reconciliation.

They can pick that up on some street corner. What worries me is that they won’t have the Bored of Education thugs around to check their junk to find out which sex they are supposed to be. Not according to the hospital but designated by the union thugs at the Bored of Education.

That is why this nation needs porta-potties with Department of Education written on them in big print.

Congress gets a few and any court that starts ranting on the subject gets one as well.

Save a few for teacher’s unions.

After the stench gets bad enough they may get the message.

Most of this incredible MAGA winning will die by Congress not codifying it. EOs are pieces of paper that can be thrown out when the next Democrat comes to office. I think some House Republicans will be scared to political death to vote in favor of dismantling the Department of Education. The Senate can’t be trusted with the usuals.

I fear this intensely.

If the current GOP congress does not pass a law officially overturning the 1979 law, then the next President will re-constitute the Department as if nothing ever happened at all.
