JUDGE: These are questions I want answers for & why you won't me: 1) How many planes departed US on Saturday carrying anyone based on Proclamation; 2) How many people in each category; 3) What foreign country/countries did they landed; 4) Time took off & wear; time you contend left US air space; what time landed in each country; what time transferred into that countries custody. 1/
2/ Judge asks Plaintiff if there are other questions that I should be asked? Direct government to provide sworn declaration was subject to Proclamation to make sure government isn't basing it on Article II and saying that is basis. DOJ: None of this is necessary because we complied with order. Judge: I will require declaration on Proclamation regarding third flight.
3/ DOJ: Points out oral order is not the injunction. And transcript said saying I would memorialize gave DOJ good faith basis to base to wait for written order. Judge: Quoting says you're saying "I'm telling you immediately turn planes around." DOJ: Minute order controls. Judge: You're telling me that very clear point is not an order. DOJ: I'm telling you the government's position; and it wasn't in written order but so written order controls. Judge: You knew that morning there would be a hearing at 5. So when I said directly turn plane around, because my written order was pithier, that can be disregarded. DOJ: It isn't a matter of disregarded, it is a matter minute order controls. Judge: So you're saying we were outside of airspace so no jurisdiction? DOJ: No, "removal" happens when they left US, so that means they were already removed which is what the Court order. Judge: Equitable power has extraterritorial reach, you can't violate it.NOTE: Judge is missing argument!
4/ Judge: My equitable powers can order you to return plane. DOJ: You lost jurisdiction once outside U.S. airspace, because once physically removed Court has lost because act is completed. Judge: Better course is return to US to figure out course then to say I don't care. DOJ: President has authority of military forces and deal with diplomatic. What are powers to continue this operation, i.e. land planes: That became issues between President & foreign affairs. Judge: Not calling into question foreign policy, etc., I'm asking how you think my powers don't attach to plane.
5/ DOJ: Order only involved Proclamation BUT removal was based on Article II powers. Once it crossed international airspace, foreign affairs power is at it zeinith. Judge: Pres. has extrapower once he has left US airspace? DOJ: He complied with written order; once outside US President has stronger Article II. Judge: My equitable powers did not end at "waters edge." Be better to argue on agreed upon facts which I hoped to get today, so lets get facts first,. NOTE: Since only remedy would be criminal contempt instead of civil contempt, Trump should just issue pardon and moot it all.
6/ Plaintiffs: You couldn't have been clearer; DOJ could come back and ask clarity; ask who made decision. Judge: When was Proclamation issued? Friday secretly or Saturday? Give me that answer by noon tomorrow. And what was intention on when it went into effect. Judge: How many people subject to Proclamation remain in US and how many in U.S. doj/plaintiffs no answers.
7/ DOJ: How many subject to Proclamation is national security. Judge: You tell me wait. Judge: Confirm no one else will be removed from United States. DOJ: Yes. Judge: Sworn Declaration that third flight was not subject to Proclamation; and why you can't answer my questions and in form you will answer them. Since my oral orders seem to mean nothing, I will put this in writing. I will let you know how to further proceed after I receive you information.
8/8 Judge is pissed. DOJ's hoping Court of Appeal's steps in. I fully expect Trump to refuse to answer because it is a nonjusticiable question and thus NOYB.

If the judge went to law school, I suspect he didn’t attend any classes on Con Law. The courts have no reviewability here. This is a matter of the Commander in Chief making decisions on national security.

It can be very dangerous to turn around a flight in midair and return home; there may not be an allowance for the fuel required as it was not factored in initially. But its more important to this judge to get this gang of dangerous international criminals back into the United States; note his reliance on the plaintiffs attorneys.

DOJ should slow walk everything. They’ll need due process to occur, gather respective documents, interview respective people, formulate a coherent response - they have the right to do that yes?
