Ed Martin, the interim U.S. attorney for the District of Columbia, has been quietly pushing to present evidence against Senator Charles Schumer of New York, the Democratic leader, to a federal grand jury over comments he made about Supreme Court justices in 2020, according to people with knowledge of the situation.
Justice Department officials have thus far rebuffed the unusual request by Mr. Martin, a partisan ally of President Trump with no previous prosecutorial experience, one of those people said.
Mr. Martin has made clear his hopes of investigating whether the remarks made five years ago by Mr. Schumer amounted to threats against Justice Brett Kavanaugh and Justice Neil M. Gorsuch. Bringing such a case is highly unusual and winning a conviction would be difficult, according to current and former prosecutors.
Last month, Mr. Martin signaled his intention to take an aggressive approach, writing Mr. Schumer a letter demanding “information and clarification” of remarks he made at a rally on March 4, 2020.
Representatives for Mr. Martin, Mr. Schumer and the Justice Department did not immediately respond to requests for comment. Mr. Trump has nominated Mr. Martin, who promoted Mr. Trump’s false claims that the 2020 election was stolen, to be the permanent U.S. attorney in Washington. But his hyperpartisan presence on social media and his targeting of opponents, while in sync with Mr. Trump’s demands for retribution against perceived enemies, might complicate his chances of confirmation.
Senator Thom Tillis of North Carolina — a Republican who serves on the Senate Judiciary Committee and provided a critical boost for Kash Patel’s nomination to be the director of the F.B.I. — recently said Mr. Martin’s confirmation would be “a real challenge.”

I think this is wise. This guy has no prosecutorial experience. Note that in Trump's first term, investigations were conducted on crimes committed but no trials were held. The Deep STate 'owned' too many people, and courts, so taking people to trial wouldfail and then protect them from every being tried again (double jeopardy).
But trials weren't held and treason, terrorism, attempts to kill a president and other capital crimes don't have a statute of limitations, and the courts are being cleaned, so the case investigations are still out there, hanging over traitor's heads.
So yes Schumer et. al. need to be investigated tried and imprisoned. But Trump is cutting deep state funding sources first (reducing big slush funds to defend Deep Staters) and I believe there is an order to dismantling the whole house of cards correctly.
And when it comes time to investigate Schumer, let it be done by pros with prosecutorial experience. Don't risk blowing the case due to adequate investigation and then he escapes with 'double jeopardy' protections.

The “speech and debate clause” has been stretched to cover nearly anything said by a member of Congress when Congress is in session.

Martin has taken the most decisive action taken in the entire Justice Department so far.
