Late Saturday, Washington D.C. District Judge Amy Berman Jackson ruled that President Donald Trump violated federal law in firing Hampton Dellinger, head of the Office of Special Counsel. Jackson’s decision is forceful, well-written, and arguably wrong under existing precedent. Indeed, it may have just set up an appeal that both presidents and professors have long waited for to reinforce presidential powers.

I’m going to lay a bet that Jackson has good dirt on Roberts that will sway his actions. She is pretty sure and cocky about this.

It is because the higher courts wou,don’t hear pres Trump’s case because lower courts had not ruled yet, now he can bring the case to the Supreme Court and get a ru,ing on it that if favorable will settle somewhat what a president has power to do, and what courts are not allowed to do concerning presidential powers. This needed to go to the Supreme Court for this reason, but sadly, even though “conservative judges” hold the majority on the court, it does not mean that they are all true conservatives, and they might rule agaisnt pr3s Trump and agaisnt presidential powers In General.

Meant to say, it needed to go to SC because lower courts are severely abusing their powers to over-ride lawful orders by the president, and it needs to stop- lower courts need to be slapped down for abusing their positions- however, Wil. The sc do the right thing? That remains to be seen

Will SCOTUS do the right thing? Probably, if it was anyone other than Trump as President. Since it’s Trump, they have to ways to torpedo him. Either refuse to here the case and take the easy way out or hear it and Roberts and his four gal pals will uphold Judge Jackson’s ruling. I don’t expect SCOTUS to give Trump a win.

Roberts has been in pretty good on restoring presidential power over executive branch agencies (sounds utterly stupid writing that). I think he understands that at some point if the the agencies, and the toady lower courts supporting them, not reigned in, they will be ignored. It wasn’t going to happen with a socialist president since they were aligned. But with a national populist prez it will. The SC will clean this up or Trump will break the judicial system.

It is going to boil down to this. Who does Roberts think holds the most dirt on him. Trump or Jackson. Whoever is holding the most dirt will prevail.

This is so simple a caveman could figure it out. A special counsel is appointed by the DOJ. And which branch does the DOJ belong to? If the special counsel isn’t accountable to the President, who is the only person under the Constitution given authority over the Executive Branch, then they are accountable to no one.

Of course a president can fire a special counsel.
