The 9th US Circuit Court of Appeals Court Says Trump Can’t End Birthright Citizenship — Battle Likely Heading to Supreme Court

The 9th US Circuit Court of Appeals has ruled that President Donald Trump cannot end birthright citizenship with his executive order, likely setting up a battle about the issue in the Supreme Court. The Justice Department had filed an emergency request for the court to lift a Seattle judge’s freeze on the policy, but the appeals court denied it on Wednesday.

CNN reports:

The 9th Circuit panel – made up of a Trump appointee, a Jimmy Carter appointee and a George W. Bush appointee – said that a closer review of the case will move forward in its court, with arguments slated for June.

The case before the San Francisco-based appeals court is one of several major legal challenges to the policy and the first to get the weigh-in by an appellate panel.

In filings, the Justice Department said that the birthright citizenship executive order was “an integral part of President Trump’s broader effort to repair the United States’ immigration system and to address the ongoing crisis at the southern border.”

Doing it’s job? Ninth Circuit with a 79 percent reversal rate... There job was to agreed with Trump and not get reversed and force the other side to appeal.

Lefties who want to replace Americans with dependent foreigners invented the idea that the children of illegal immigrants are birthright American citizens. It’s hogwash and has been since day one. Here’s proof - Native Americans had to be given birthright American citizenship by act of Congress (passed in 1924). That is decades after the 14th Amendment was passed (in 1868 to be specific). The Supes need to fix this. It’s not difficult to figure. See also the comments made by the authors of the 14th Amendment for legislative intent.

So it’s less “He can’t do that and that’s final”, and more “let’s put this on hold for a bit while we actually hear the arguments”.

Unexpected of the 9th Circus of old, but IIRC, Trump improved the 9th during his first term...

It was expected to rule the way they did. They just needed to make the ruling so Trump could move on.

This has to end up in the Supreme Court. Any lower court ruling is irrelevant.

Agree, and if it fails then, Congress will need to move to correct this either by law or Constitutional amendment if needed. This needs to stop !!

Birthright citizenship flies directly in the face of our US Constitution and every lawyer worth his/ her salt knows this. And knows it well. There’s no doubt how this will end. But prolonging and exacerbating their damage to America is the left’s core agenda. So they try everything they can to screw us and muck up the gears of any reforms or corrections of their agenda.

Trump can do it.

It’s just a question of whether SCOTUS can gin up a rationale for finding that Trump is wrong in his conclusion. And have that rationale pass the smell test.

FWIW, This Guy can’t think of any such rationales.

Leading This Guy to think, Trump’s conclusion will win the day.

Children born in a country, without even a hint of foreign spice at birth, are that country’s indisputable, undefeatable, a.k.a., natural, citizens. We need a SCOTUS ruling essentially saying this, and then drawing a distinction between this class of citizens, and ALL other citizen and non-citizen denizens. Only then will it become clear to the U.S. populace why Trump’s logic is sound. And it is sound.

I predict that SCOTUS will vote to hear this case before another circuit rules to the contrary. It’s just a matter of whether SCOTUS takes the case before the Ninth Circuit issues a full ruling, or whether SCOTUS decides to take it before that.

If the founders meant that everybody born here was a citizen then they would have said so.

But there is a second part that the Liberals want to ignore.

How can two foreign citizens who enter our country illegally create a US citizen?

There’s only two kinds of non-naturalized citizen recognized in the U.S. Constitution, natural Born citizens, and grandfathered-in citizens. Time then went forward from 1788, and everybody else who subsequently became a citizen, other than our natural stock of citizens born here each year to U.S. citizen parents, is (or was) a naturalized citizen, made so either by action of a Congressional statute (”an uniform rule of Naturalization”), or by action of the 14th Amendment.

14th Amendment citizens were never natural Born citizens.

To add, this malarkey over “subject to the jurisdiction “ is another bunch of hogwash. If I was arrested and jailed in Germany, I would be subject to the jurisdiction of Germany but I would not be a German citizen.

Conversely, if a Honduran is jailed in the US that doesn’t make them a US citizen either.

Let’s hope mommy Amy Coney Barrett doesn’t side with the leftists on the Court on this issue, which is the largest magnet to illegal immigration. I am aware of several women (thru work contacts) that spent the last several months of their pregnancy in the US visiting their relatives for this purpose.
