Delco DA Stollsteimer: I Won’t Help Enforce Immigration Law on ‘Peaceful’ Illegal Aliens(DELCO, PA)

Delaware County District Attorney Jack Stollsteimer portrays himself as a law-and-order Democrat. But there are some laws — America’s laws against illegal immigration, for example — he refuses to enforce.

“I am directing that CID (Criminal Investigation Division) staff are not to work with immigration officials to target for enforcement actions individuals not legally in our country but also not committing criminal acts,” Stollsteimer posted in a message on Facebook. “Simply put, we will not participate in ’round ups’ of people living peacefully in Delaware County.”

The two-term D.A. insists his office will help Immigration and Customs Enforcement with cases involving people who are breaking U.S. immigration law, as long as they are charged with an additional crime as well.

For what crime?

Look, there is nothing requiring state law enforcement officials to assist federal law enforcement on immigration or anything else, so the order on its face is legal. If they actively obstruct a federal action, that's different.

I'm sure the feds also are looking at what federal funding they can legally strip from local governments that don't assist federal law enforcement.

Sadly, you are correct. State and local law enforcement agencies are not obligated to assist in federal immigration enforcement. While they may cooperate voluntarily through data-sharing or collaborative programs, the U.S. Constitution’s anti-commandeering principle prevents the federal government from forcing states or municipalities to enforce federal immigration law. If you are researching a specific jurisdiction’s policies, it is important to look at relevant state statutes, local ordinances, and any formal agreements (like 287(g)) that local agencies might have signed with federal agencies.

However, tipping off illegals can be argued as obstructing federal actions which would be actionable.

I’m unsure if the act of harboring an illegal is a crime, in which case, it could be argued that he is doing.
