Eviction filings shouldn't doom Pa. residents to never get another rental, Shapiro says

HARRISBURG — In his annual budget address, Democratic Gov. Josh Shapiro urged the divided Pennsylvania legislature to pass a measure that would seal eviction records for potentially hundreds of thousands of people.

In 2024 alone, more than 115,000 tenants in Pennsylvania faced eviction filings. And while most filings end with rulings in favor of landlords, housing advocates told Spotlight PA that about a quarter do not, and some are never even adjudicated.

Regardless of the outcome, that original eviction filing stays in a tenant’s public records indefinitely and can negatively impact their ability to find a place to live. Often, landlords use third-party screening programs that automatically scrape state records for past evictions.

Shapiro endorsed sealing records “if you weren’t actually evicted.”

“As soon as an eviction is filed, it becomes a permanent mark on someone’s background, even if that case eventually gets ruled in the tenant’s favor,” Shapiro said in his budget address Tuesday. “That makes no sense.”

Landlords have broad discretion to evict people so long as they allege a tenant breached any term of their lease. Those terms can include continual late rent payments, repeated noise complaints, or a tenant failing to switch utilities into their own name. Some landlords give tenants notices to leave, while others go directly to local courts to file eviction notices. Once a notice is filed, tenants in most of the state must address it in court.

Only Philadelphia requires landlords and tenants to participate in an eviction diversion program before a filing is made.

Shapiro’s pitch was light on specifics.

More assault by Shapiro on private property rights. If Kameltoe got in, she would make this nationwide. We already have it in New York State (sealing eviction records). Landlords don't file evictions for fun. It is because of non performing and low performing tenants.

the renters know they have government protection and just stop paying rent leading to eviction filings that take years because of “renters rights” put forward by thier protectors.

they are getting ready to outlaw that as well. LawNY.org is trying to get legislation passed to ban ALL screening of tenants. Very bad for good tenants. Good tenants get to live next door to rotten tenants. No incentive for tenants to do better.

They’re doing this in Oregon as well. It’s insane. You can’t check credit, you can’t check criminal history, and now you can’t check eviction history. Who do these tyrants think they are? So glad my wife and I got out of the landlord business long ago.

It is potential future landlords that will choose never to own property in PA that are the “unseen” effect of such legislative approaches.

Fewer property owners means consolidation by the “big boys” which will give tenants even less negotiating power.

Landlords depend upon eviction notices to determine a whether a person should be rented to. For instance, my Mom owned real estate. Where the real estate was located, it takes about 60 days to six months to evict a tenant. So four people get together and one of them rents a place. They pay for about 60 days (to establish a record of paying). Then the tenant stops paying. After they get evicted one of the other four rents another place. Oh yes, the tenant’s excuse is that they lost their job, so while they ultimately get evicted, they have a justifiable excuse.
By rotating who rents there is a lapse between the eviction and the next time they get evicted. This why due diligence is absolutely required for renting to others.

As an added bonus as decent small time landlords leave the business, (because these ‘protected deadbeats’ will drive them out of business, big government commie boys will step in with Cabrini Green solutions: Government housing at it’s most nightmarish...Shapiro’s an idiot.
