Trump can’t move trans women to men’s prisons or deny gender-affirming care, judge rules

A federal judge has blocked Donald Trump’s administration from forcing three incarcerated transgender women into men’s prisons and taking away their gender-affirming healthcare.

The order on Tuesday from Washington, D.C. District Judge Royce Lambert – who was appointed by Ronald Reagan – temporarily strikes down part of Trump’s sweeping executive order on gender as a likely violation of the Eighth Amendment’s prohibition against cruel and unusual punishment, landing yet another court-ordered blow to his agenda.

A pair of lawsuits filed by incarcerated trans women have accused the president of endangering their lives while stripping them of their healthcare through an executive order that “categorically bans transgender healthcare regardless of medical necessity,” according to the D.C. lawsuit.

Trump’s order “prohibits prison medical providers from treating transgender patients’ gender dysphoria on an individual basis, according to independent medical judgment,” serving as a “blanket ban that “will deprive Plaintiffs of essential treatment, putting them at high risk of serious harm,” according to the complaint.

The three trans women at the center of the case in Lambreth’s court feared the loss of their healthcare and a heightened risk of sexual abuse and violence if they were moved to men’s facilities.

Lamberth agreed that the women faced a “significantly elevated risk of physical and sexual violence” and “numerous and severe symptoms” without appropriate medical care.

It's cruel and unusual punishment to force women to share private facilities with men.

This will be interesting to watch.

Hey Judge, the courts job is to assess guilt or innocence. When adjudged guilty and incarcerated, they are remanded to the executive branch to house.

I wish I knew more about the courts.

What cases can POSSIBLY end up in front of the SCOTUS and what cases CANNOT.

I’m not speaking to whether or not the SCOTUS decides to hear a case...just if they CAN if they want.

I gotta read up.

It all gets confusing with so many different arenas.

Let’s have the judge first define what is a woman before he rules, otherwise his ruling is capricious, rending it invalid.

Ignore the judge, move the man to a male prison, the judge can muster his battalions to stop Trump if he wishes.

Move them all to one Federal prison near a major hospital.

Or, contract out to a private prison company.

The judge can’t just decide what sex a prisoner is. A Reagan appointee? Long past his date of spoilage.

The problem is, once someone’s system has been pumped full of the wrong hormones, cutting them off cold turkey probably IS harmful. And if they’ve had bottom surgery and a bunch of estrogen, they ARE at risk in a male prison. I suspect the best we can do is put them in their own section, and stop others from getting into that situation in the first place.

There is no such thing as most are fags, mentally ill, or both. The lower courts on up are going to have to rule on this and it’s going to take many years to reach the SCOTUS. Even that demented clown on that bench claims she ‘doesn’t know what a woman is.’

So if an inmate thinks he’s the Queen of England, does the prison system need to go along with the ruse to avoid that inmate suffering “symptoms”?

The doctrine of standing is confusing because there is a lot of ad hoc improvisation. Here is a practical reading of it. If the Supreme Court wants to hear a case, it will find a justification to hear it. Conversely, if it doesn’t want to hear a case, it will find a justification not to hear it.

Trump samo is to losing the lower kangaroo courts and win in the higher courts. Plenty of this is expected.
