an 11 (Reuters) - U.S. Special Counsel Jack Smith, who led the federal cases against Donald Trump on charges of trying to overturn his 2020 election defeat and mishandling of classified documents, has resigned, as the Republican president-elect prepared to return to the White House.
Smith resigned on Friday from the Department of Justice, according to a court filing on Saturday to U.S. District Judge Aileen Cannon, asking her to lift a court order she issued blocking release of his final report.
Notice of Smith's resignation came in a footnote in the filing, which said the Special Counsel had completed his work, submitted his final confidential report on Jan. 7, and "separated" from the Justice Department on Jan. 10. A former war crimes prosecutor, Smith brought two of the four criminal cases Trump faced after leaving office, but saw them grind to a halt after a Trump-appointed judge in Florida dismissed one and the U.S. Supreme Court -- with three justices appointed by Trump -- found that former presidents have sweeping immunity from prosecution for official acts. Neither case went to trial.

Two thoughts:

He can't be allowed skate, given what he has done.
How can he resign from a position to which, according to multiple legal beagles, he was illegitimately appointed?

Resigning is a legal defense for him, likely he may try to claim he is no longer in the position so their is no legal standing to hold him accountable, the issue has been corrected.

Smith requires jail time. If Smith is not bankrupted, then jailed, there is no deterrent for the next communist that wants to try lawfare.

Resigned from his position as a FedGov employee, not just from (not actually) being a Special Prosecutor.

The lies are already delivered.
The Demoncrats are already taking the felon label to the extreme.
But the pushback is delicious. The name-calling isn’t working anymore, and the example the Demoncrats have just left everyone is going to hurt them, BIGLY.

possibilities include Ukraine, Iran, Moldova, Uganda, Brunei, Somalia, Cambodia, Laos.....

There must be punishment for those that did wrong and those that ordered people to do wrong, especially under threat.

Hard to see how Smith gets jail time for doing a job he was commissioned to do. That also means any effort to sue him personally would be baseless, since his acts have been within the course and scope of his appointment.

If someone were to prevail in a liability claim, it still would be you and I paying the judgement, just like we do when police officers kill the wrong person.
