President-elect Donald Trump asked the Supreme Court Wednesday to pause his upcoming criminal sentencing and consider whether his guilty verdict in Manhattan should be thrown out, as the sentencing is now scheduled to take place Friday after a New York appeals court Tuesday shot down Trump’s request to pause it.

I don’t know. I guess you can appeal before sentencing, or after sentencing ask for the sentence to be suspended pending appeal. The rumor is that the sentence will not include incarceration so maybe the SC will wait. There are many avenues of appeal, and many reasons why the trial was an error (to put it kindly). Didn’t cite the specific felony, didn’t allow some testimony, jury instructions were incorrect and improper etc. So he should continue to appeal it no matter what the sentence is. He’s fortunate to have to money to fight dollar for dollar. Most people just get crushed by the process.
I think the convictions were bogus and should be overturned on appeal, but this stay shouldn’t and likely won’t be granted.
You bio says your a lawyer, odd you think it shouldn’t be stayed, one criteria for a stay is the individuals likeliness to prevail.
Given you said he is likely why do you say he should not have it?
I’m not a lawyer, but an oilman, so I deal with lawyers.
Typically, you can’t appeal to the next level until the first level is done or is going to do something that can’t be undone easily.
So a criminal case can’t be appealed until someone is convicted and sentenced or currently imprisoned.
... But somehow it can be preemptively pardoned?
The US Supreme court has to review the issue on a federal level regarding constitutional implications.
The legal system is a ritualistic Kabuki dance which is more concerned with "process" than it is with "Justice."
What happens if the judge puts conditions of probation on him? As a president he cannot see what he wants? As a president his schedule Hass to be interrupted occasionally to meet with a parole officer? Act he does as a president cause him to violate parole? And that doesn’t even touch on what happens if a judge decides he should be in prison.
That doesn’t even touch up on the hard cold fact that the entire prosecution was a bill of attainder. Politicians ran on trying to find ways to prosecute him, the judge was on the take and the trial was fraught with illegal rulings.
If this happened in Selma Alabama in the 1950s everyone would instantly know it was a corrupt trial and a violation of Donald Trump’s civil rights.
It doesn’t matter whether or not he gets prison. You cannot have a sitting president on probation, under the supervision of a judge. Especially when that judge is on the take, and his daughter is excepting the bribes.
In this case, it is not accurate to say that. He is not appealing the facts of the case, nor the conviction. It’s a direct appeal based upon violating his civil rights, and the rights of the presidency. So it does not have to go all the way to completion. It’s us issue separate from the case itself that he is appealing on.
I am an uncertain of your point.
If you are talking about a presidential pardon, then, yes, that can come at any time during or before the process. Completely different concept.
I don’t disagree. But I’m uncertain if there is any other better system.
If you come up with it, write a book.
That makes perfect sense to me.
Pedo Joe is a liar. The rare handfuls of White supremacists are not a “great threat to anything.” It’s a far-left liberal myth that white supremacy is “widespread”. Feral Government “judges” and “courts” are the greatest threat to American freedom and liberty.
Yes, he should serve no time, but all they want is to be able to publish Trump as the first sitting President felon and smear his name further.
If you come up with it, write a book.
I write about the legal system quite a lot on Free Republic and elsewhere. I dare say I *HAVE* written a book on the subject.
:)
He can jump probation. In DC, he’s a fugitive, and the FBI can be after him, and when they overtake him at Camp David or in the WH, he can order them to stand down. Or he can set up a satellite oval office in Sing Sing. The sitcoms that these possibilities could create.
