Biden bans new offshore oil and gas drilling in most federal waters in last-minute effort to stymie Trump

WASHINGTON — President Biden is moving to ban new offshore oil and gas drilling in most US coastal waters, a last-minute effort to block possible action by the incoming Trump administration to expand offshore drilling.

Biden, whose term expires in two weeks, said he is using authority under the federal Outer Continental Shelf Lands Act to protect offshore areas along the East and West coasts, the eastern Gulf of Mexico and portions of Alaska’s Northern Bering Sea from future oil and natural gas leasing.

“My decision reflects what coastal communities, businesses and beachgoers have known for a long time: that drilling off these coasts could cause irreversible damage to places we hold dear and is unnecessary to meet our nation’s energy needs,” Biden said in a statement.

“As the climate crisis continues to threaten communities across the country and we are transitioning to a clean-energy economy, now is the time to protect these coasts for our children and grandchildren,” he said.

Someone smarter and more informed please explain how the outgoing president can create ban via fiat that somehow would then require congress to undo and restricts the incoming president.

I cannot find anywhere were this is a law or even regulation, they just keep saying Biden did it, was it an executive order, is he using a previous regulation via interpretation?

I jusy can not see how Trump can not undo this day one given what has been presented so far.

What Trump has to do in response (other than overturning this move) is to BAN all offshore Wind Farms (and ban them on federal lands also).

He’ll try, no doubt. However, will Congress go along with it?
It’s been explained to me that the matter it was done cannot be undone by a President without the help of Congress. It’s defacto permanent if Trump has an uncooperative Congress on this issue.

It sounds strange. From the article:

Biden’s actions, which protect more than 625 million acres of federal waters (an area roughly one and a half times the size of Alaska), could be difficult for President-elect Donald Trump to unwind, since they would likely require an act of Congress to repeal. Trump himself has a complicated history on offshore drilling.

Exactly, “would likely require” is garbage language with no legal meaning, many precedents legally have been established that one president cannot bound another’s actions, only through laws can this be done. Biden is not signing anything into law, he is using a power given to him by a regulatory act, Trump will have that same power.

They keep avoiding stating what he is actually using to enact this ban and present is as fear mongering defeatism.

That’s for sure. But what has to scare the Left is that a LOT more people are now unwoke, and that includes millions of people who think they conservatives (other than Massie), due to 4 years of Biden. It’s going to be a very rough ride for the Left, for a long time, if we make it through the next two weeks without those clowns starting WW3.
