Yup, Democrats Will Stall Trump’s Nominees at Every Turn

The new year began on a violent note, as a terror attack on Bourbon Street in New Orleans left at least 14 dead and dozens injured. The suspect, reportedly inspired by ISIS, used firearms and an improvised explosive device.

The FBI bizarrely hesitated to immediately label it as terrorism. Meanwhile, a potential terror attack also unfolded in Las Vegas, where a Tesla Cybertruck exploded outside the Trump Hotel. These incidents highlight America’s vulnerabilities and the need for strong leadership in federal law enforcement. As such, many were calling on the swift confirmation of Trump’s nominees to lead the Justice Department and the FBI.

“After what appears to potentially be an ISIS inspired terrorist attack last night in New Orleans, it's even more vital that we quickly confirm all of President Trump’s nominees,” freshman Senator Bernie Moreno (R-Ohio) said New Year’s Day. “Every single national security nominee should be confirmed & ready to protect America by January 20th.”

Well, despite the legitimate concerns, it looks like Democrats are prepared to stall Trump’s nominees. On Sunday, Sen. Amy Klobuchar (D-MN) stated on CNN’s “State of the Union” that there is no need to rush the confirmation of President-elect Donald Trump’s nominee for FBI director. Klobuchar bizarrely argued that the FBI is “very functional” and does not require immediate leadership changes in light of these events.

“In light of the New Orleans terrorist attack, Trump allies are urging you and your colleagues in the Senate to move quickly on confirming the president elect’s national security team,” began host Jake Tapper. “You have signaled some opposition to Kash Patel serving as leader of the FBI but Republicans say delaying his confirmation will hurt operational security. How do you respond to that?”

The head of the FBI is a conspiracy theorist and publicly stated Trump was not shot, merely injured by shrapnel!

I can’t think of a better reason to keep the same rules as the last administration and Investigate every elected demonrat in DC, then go to the States.

BS. The Republicans have an absolute majority in the Senate. If any of Trump’s nominations are held up, it will be because RINOs hold them up. The Democrats are simply doing what you’d expect.

This dude who claimed Trump was injured by shrapnel, not shot, is currently head of the FBI! He stonewalled Congress and said he had to catch a plane (to his vacation spot)! And Kolbuchar says the FBI is in good hands!

Pres. Trump needs to take a close look at the Vacancies Act.

Generally, the Vacancies Act imposes a 210-day cap on the period during which someone can execute the functions of a PAS position on a temporary basis.

The time limit begins to run on the date the vacancy occurs.
Years in which a first-term president is inaugurated, however, are treated differently.
(*Could Pres. Trump still be considered a first term president?)

Positions that are vacant during the 60-day period beginning on Inauguration Day may be filled in an acting capacity for up to 300 days (in other words, 90 days longer than the general 210-day cap). For example, the 300-day limit for a vacancy that existed on inauguration day on January 20, 2017 ran through November 16, 2017.

The time limit for an acting official is suspended, however, if the president nominates someone to the PAS position. For example, if someone is serving as acting deputy secretary at a cabinet agency and another individual is nominated to that position, the 210- or 300-day countdown (whichever is applicable) would effectively stop while the nomination is pending before the Senate.

If the nominee for that deputy secretary position is rejected, returned or withdrawn, the president is provided an additional 210 days in which an individual may serve in that role in an acting capacity. If a second nominee is submitted for the deputy secretary position, the 210-day countdown is again suspended while the nomination is pending. If this second nomination fails, the acting official may serve another 210 days after the failure of the nomination. Once that 210-day cap is reached, the position is considered vacant.


Near as I can figure, If he works it right, he can have his people in these positions for as long as he wants and can bypass congress altogether.

Example: Appoint Pete Hegseth as acting. Let him serve 208 days. Nominate him to the senate on day 209. Withdraw him on day 210. Appoint him acting on day 211. Wash\rinse repeat.

Nope. They can still delay things by bogging the Senate down with other procedures...but they cannot block them by a filibuster requiring 60 votes for cloture anymore.
