With little time left to force his liberal agenda on the United States, President Joe Biden and his administration have launched a “striking escalation” of rules and regulations that conservative critics hope President-elect Donald Trump can reverse once in office.
Over the past month, the administration has broken the record for the number of pages of regulations in Uncle Sam’s book of rules, the Federal Register.
And this year, the administration has pushed through a high number of economically impactful rules, those with a hit of $100 million or more.
Conservatives are hopeful that the incoming Trump administration is paying attention to the Biden administration’s bid to lock in the red tape. Trump and Congress could reverse some of the costliest regulations through the arcane Congressional Review Act.
“The Federal Register’s page count hit 101,836 on Tuesday, surpassing the 2016 Obama-era record of 95,894 pages. This marks a striking escalation in regulatory intensity,” said Clyde Wayne Crews of the Competitive Enterprise Institute.

The regulation watchdog added in his latest blog shared with Secrets, “What matters for those aiming to overturn Biden administration rules is the sharp increase in completed major rules: 146 in total across the spring and fall 2024 agendas, compared to 91 in 2023. Among these, some rules from the spring agenda and the 49 completed major rules in the fall agenda may be especially vulnerable to [Congressional Review Act] challenges by the 119th Congress and the incoming administration. That’s not even counting a broader set of 114 ‘other significant’ rules completed in the fall agenda.”
Trump has promised to eliminate dozens of Biden-era regulations, including those related to the Green New Deal and energy production. His incoming budget and management team have been champions of curbing regulations.

Regulations issued under laws passed by Congress shall only be admissible to court by a defendant to protect the defendant, unless the regulation has been adopted by Congress by law to be law.

It isn't "100,000 new regs." Rather, it is 100,000 pages in the Federal Register. Big difference. One major new rule, adopted through the notice-and-comment rulemaking process, might have had an explanatory preamble for the proposed rule that spanned many dozens of (and, in some cases, several hundreds of) pages. Same with the final rule, where the promulgating agency is required by law to set forth in the preamble its responses to the major public comments its received on the proposed rule.
As this story goes on to point out, the number of rules that were actually promulgated in 2024 isn't all that much different than in prior years. The increase in Federal Register pages reflects the promulgating agencies' getting somewhat "wordier" than in prior years.
This, too, makes a certain sense (in terms of being expected, that is). With the Supreme Court having overturned the so-called Chevron doctrine with its Loper Bright decision, agencies are now at greater pains to explain in even more detail the legal reasoning underlying their actions.
Nope. Doesn't work that way. Absent Congress taking action under the Congressional Review Act -- which only apply to "major rules" (i>i.e., basically, those determined to have at least a $100 million effect on the economy), so-called "legislative rules" adopted through the notice-and-comment process, can only be rescinded or revised through that same process. This will take many months. Such rules cannot be unilaterally revoked through executive action.
The idea that Trump, upon taking office, can simply snap his fingers, or wave a magic wand, and make legislative rules go away is nonsense propagated by idiots or propagandists.
Now, Biden's Executive Orders? Sure, Trump can (and will) rescind those with the stroke of a pen on Day One. But legislative rules? No, that's simply not how our system of government works, ever has worked, or could be made to work absent significant changes made by Congress to the administrative law structure in this country.
Most of these new regulations are bureaucratic and can easily be reversed. Most of the regulations in this country are made by mid level bureaucrats not legislators. Hence the recent Chevron ruling by SCOTUS.

No. There was a regulation count thrown up on TV, comparing 0bamas regulation count to Biden - Biden was the winner with 98,000 new regulations during his term (and counting - thus the 100,000 target).
