A Manhattan jury has cleared Daniel Penny of criminal wrongdoing in the chokehold death of Jordan Neely on a crowded subway — a caught-on-video killing that sparked fierce debate over the city’s mental health system and crime underground.
The panelists acquitted Penny of criminally negligent homicide — which could have put him behind bars for up to four years — in Neely’s chokehold death aboard a crowded uptown F train in May 2023.

Good. The judge’s little game failed. There should be federal investigation’s into the entire justice system in New York as the majority are not obeying their oaths.

Assuming that you’re right, then I may have been right in saying that there was only one holdout, which, of course, was the juror wearing a mask.

Interesting, all of the pundits were talking about how the jury might be looking to find him guilty on the lesser charge when they could not agree on the top charge. They dropped the top charge and the jury found not guilty on the lesser included.

That’s good, but unfortunately, Penny has to defend himself in a civil case brought by Neely’s family.

He is free from the criminal, now the civil will pile on of course.
I wish he could sue that piece of crap DA for even making this an issue. I hope Bragg gets on a subway and finds Bernie Goetz II.

Total backfire on Bragg and the judge. They dismissed the first charge and cannot re try him for it.

A buddy on my sports site made the same comment about the guy with the mask being the holdout. But clearly, someone changed their mind because if there were holdouts to convict on the more serious charge, they should have wanted to convict on the second charge as well.
So, it is kind of surprising result that I think neither the DA or defense likely expected. DA probably counted on another hung jury at worst.
