This week, Daniel Penny’s defense attorneys flagged Judge Maxwell Wiley to what they say are improper and misleading actions by Manhattan District Attorney Alvin Bragg’s office working with the media.
Penny, a 26-year-old Marine veteran, is on trial for the death of Jordan Neely, whom Penny restrained on the NYC subway last year after Neely allegedly threatened passengers.
The defense says Bragg’s office has been aggressively pushing the media to add in their coverage that there’s no mandatory minimum sentence if Penny is convicted on the second-degree manslaughter charge.
“The District Attorney’s efforts to have the jury speculate as to a potential sentence are both improper and misleading,” Penny attorneys Steven Raiser and Thomas Kenniff told Fox News. “While it is technically true that these charges do not carry a mandatory minimum, that is the case with most felonies in New York. It is equally true that the maximum sentence is 15 years in state prison.”

I don’t understand how they can find the guy guilty of anything. He was trying to protect and save the others on the subway train. I don’t know how Bragg sleeps at night.

Yes. The protestors are threatening the jury that George Floyd riots will erupt if Penny is acquitted. This is the same tactic used to intimidate the Derek Chauvin jury.

As others on different threads have pointed out, this matter is different than (say) President Trump on trial for his accountants’ QuickBooks categorization choices. ;-)
At least one maybe more of the jurors appear to be “straphangers” themselves. They daily see the filth and disorder into which NYC has descended and they see Daniel Penny as part of the necessary solution.
If I was “that guy” holding out for acquittal, I might be feted as a hero by a decent number of my peers!

If the jury hangs I guarantee it’ll be retried.....this is all about making an example of this young man and punishing the White man.
I know how that sounds but I truly believe it.
Maybe the holdout is for guilty. Not likely, but it could be the case.

The selective prosecution of white citizens seems to have begun with Bernie Goetz and gotten worse ever since.
It could be either way. There could be one or more holding out for conviction. We don't know. We can't know. We can only hope for the best although there's no question the jury seems hung at this point.

The black guy who stabbed Neely got off scot free. But they’re going after whitey who in no way killed him. It is racial, pure and simple. Penny needs the key to the city and a parade, not all this.
