The Ninth Circuit has long been the left-most federal appellate court in the United States. However, the day after Thanksgiving, the Ninth Circuit issued a decision that must have made President-elect Donald Trump very happy: It concluded that the Supremacy Clause means what it says, namely, that when it comes to the border, local political bodies cannot use regulations governing private parties to override the federal government’s supremacy on immigration matters.
United States v. King County revolved around Boeing Field, an airport in King County, Washington (i.e., the Seattle area). In 1941, King County conveyed the field to the U.S. government for wartime purposes. In 1948, the government reconveyed the field to King County. However, one contingency of the Instrument of Transfer was that the U.S. retained full access to Boeing Field
...
Having dealt with some silly procedural issues that King County raised and addressed questions about whether the U.S. had retained rights in Boeing Field (it had), the Court got to the serious substantive issue. That was whether a local government could indirectly block the federal government’s ability to act within its sphere of power—a sphere that entirely encompasses immigration enforcement. The Ninth Circuit concluded that local governments cannot do that.
These two sentences say it all:
It is of course true that “[p]rivate contractors do not stand on the same footing as the federal government, so states can impose many laws on federal contractors that they could not apply to the federal government itself.” [snip] That said, “any state regulation that purports to override the federal government’s decisions about who will carry out federal functions runs afoul of the Supremacy Clause.”

this really would have been something 60 years ago. Ted Kennedy put the nails in the coffin and there’s really nothing that can be done. Shut off the flow of illegals, close the border and deport the bad hombres and there are still enough people here to turn what’s left of America into the new Azteca Empire that will have Chinese subtitles. Stick the proverbial fork. Good luck to Trump but it’s literally like sweeping the ocean with a broom.
9th circus said this? I guess pigs can fly after all.
The issue is not that there is not a lot that can be done, it’s the fact that there is a lack of will to actually do what is necessary
Ding! Ding! Ding! We have a winnah!
mrmeyer nailed it!
Did the Ninth Circuit rule it OK to kick them in the ass on their way out the door?
exactly. The problem could be solved but what is necessary will never be done. Too many bad optics. Every screaming baby would be the top story. They will head for the catholic churches and have sit-in’s. Satan needs this population to be bred out and not much is going to stop him unfortunately. The solution- mass, merciless deportations of the bad and” good “hombres, rescind anchor baby status, fine businesses exponentially- none of these things will happen so start learning Spanish
Had they ruled otherwise, a lot of federal orders for things like desegregation would have been vulnerable to challenges on the same basis.
Under Trump...and thanks to McConnell’s due diligence, the ninth circuit was totally changed.
This “decision” by the 9th Circus is designed to screw with Texas and states’ rights. It basicazlly tells the states to “f’k off” while the Feds hug and kiss every goddamned military-age illegal coming across the border and loads them down with all kinds of goodies, including access to young American females with which to make anchor babies.
It’s like eating an elephant, one bite at a time. #1 tactic should be to end funding to NGOs and SSI to Humanitarian Parolees (if they can’t end SSI at least cut it to 2 years instead of 7). Those who have been here years, haven’t committed crimes and are productive could be Sponsored ((including financially) by a natural born IS citizen. There are many ways to fix this a little bit at a time but the Swamp always screws it up with ‘comprehensive immigration’
BS. We could deport 10,000/day that is 3.6 million/year. Over 4 years that is over 14 million. That is a VERY OBTAINABLE GOAL.
You are what we call a “concern troll”. Go away.
I was just reading about Andrew Jackson and the South Carolina nullifiers. Jackson said he would personally hang anyone who dared defy Federal laws, and he wasn’t kidding.
The difference is Texas is upholding Federal law by Constitutional means. The others are violating Federal law by unconstitutional means.
EC
“LET’S ROLL!” Mexico has a new female president so the invaders don’t need “asylum” anymore. Time to go the hell home.
I can’t believe this ever was a question. Common sense isn’t so common.
So a deal with some rathole little country to accept any deportees who refuse to declare what country they came from.
Drop ‘em off and let time tell.
nope, I’m a realist. The numbers are against us. This has gone on for too long unchecked. Look at Europe. Just a matter of time when the little ones start having kids of their own. The native population is busy aborting and transing/sterilyzing to save the planet. Foreigners don’t have that problem.
