A federal judge denied a request to dismiss a gun charge against an illegal immigrant in Ohio who had been in the US for more than 15 years, rejecting the man’s argument that he has a right to bear arms.
Carlos Serrano-Restrepo was charged earlier this year and was subsequently indicted for possession of a firearm by an alien unlawfully in the US, according to WSYX.
The Bureau of Alcohol, Tobacco, Firearms and Explosives began investigating and watching Serrano-Restrepo after he purchased at least 22 firearms, and claimed to be a US citizen on the firearms forms.
Agents conducted a search of his home and seized roughly 170 firearms, tens of thousands of rounds of ammunition and smoke/marine markers.

The suspect’s lawyer submitted a motion to dismiss the charge on the argument that he has the right to bear arms under the Second Amendment.
The judge denied his motion to dismiss the charge on Thursday, writing in his opinion that “disarming unlawful immigrants like Mr. Serrano-Restrepo who have not sworn allegiance to the United States comports with the Nation’s history and tradition of firearm regulations.”

Early in our history we had laws that forbade selling guns to Native Americans. Very similar. Native Americans are now citizens - they weren’t always (Coolidge signed the law in 1924 btw). This passes the Bruen test (part 2, history and tradition).

I’m actually trying to get the GCA of 1968 overturned at present. I believe I have a legitimate case for a client. I’ve been denied in magistrate court and denied at US District Court, so now it’s on to the 8th Circuit, which is basically an automatic denial. There’s only one stop after that, and I’ll gladly argue it if they accept it. Now in the event of this individual, I’d have never even considered filing that motion.

Purchasing 22 firearms is probable cause or reasonable suspicion of him being an illegal alien ?
Is purchasing 22 firearms a “trigger” for ATF watch someone ?

I don't know - there's only one overt stooge on that appeals court.
It will be interesting if it gets appointed to the panel.
They’ve rejected every attempt so far. See US v. Jackson. Unfortunately, the 8th Circuit, who I certainly align with politically as a whole, will rubber stamp almost anything pro-law enforcement. If one CAN get a good decision from the 8th, it carries a lot of weight. It’s just tough to do.
