Biden judge rules that Iowa can check ballots of potential noncitizens in loss for ACLU

A federal judge ruled Sunday that hundreds of ballots from potential noncitizens can have their validity challenged, while critics say that it will threaten the voting rights of recently naturalized citizens.

The case was brought by the American Civil Liberties Union in Des Moines, the capital of Iowa, on behalf of the League of Latin American Citizens of Iowa and four recently naturalized citizens who were on the state's list of questionable registrations to be challenged by local elections officials.

U.S. District Judge Stephen Locher, who was appointed by President Joe Biden, sided with the state, according to Fox News. The state's representatives argued that the process of investigating and possibly removing 2,000 names could prevent illegal voting by noncitizens.

In his ruling, Locher cited a U.S. Supreme Court decision from earlier in the week which allowed Virginia to resume its process of removing names of potentially noncitizen voters from its rolls. He said that this effort by the state doesn’t actually remove anyone from the voter rolls, but instead requires some voters to use provisional ballots.

At last: A Judge who recognizes that his oath is to the defense of the Constitution of these United States and NOT one of loyalty to the tribe who placed him on the Bench!

As usual it is very difficult to understand these arguments. I assume that there are laws and regulations regarding voting rights, such as when you have to have become a US citizen latest to be eligible to vote in a given election. I also assume that the recently naturalized citizens would be told to bring their documents if they want to vote. At least that is how it would be done in most other Western countries. So, what is the problem...?

(Yes, I understand that this is a ruse to make it possible for non-citizens to vote, but still one would assume that the arguments should contain some logic.)

Locher is only nominally a "Biden judge".

He was a magistrate judge of SD Iowa, appointed magistrate under the aegis of a Dubya chief judge.

I guess they needed the district judge seat filled, so he got the nod. Voice vote.

Good now they can check them and then let us know the results. Could be very interesting. Of course we already know that the federal government will in no way cooperated in identifying illegals.

Once they’re on the bench, they’re on for life or good behavior. So they can turn around and screw whomever they want, should the law require it. Or just out of plain meanness, depending on the judge. Only deterrent is the prospect of getting reversed on appeal for outright arbitrary rulings.

If you are recently naturalized, you get a certificate, and simultaneously are assisted with applying for a passport and passport card. Not hard to prove you are eligible.

This ruling was about people with questionable voting eligibility due to unclear citizenship status voting by provisional ballot.

The provisional ballots are segregated to allow the voter to resolve the eligibility after the election. In this case, the ballot would be counted after the voter brings in proof of citizenship.

This is no big deal unless you want illegal aliens and other non citizens to vote in our elections. I have had to vote via provisional ballot in the past.

I think the reason was because I had a recent change of address and my new address was updated on my voter registration information but not on my drivers license ID.

I was given a provisional ballot to vote on and I came back the next day with a utility bill as proof that my new address was in that precinct. It was no big deal and I didn't think twice about using the provisional ballot.

Nobody in the ACLU cared to file lawsuit on my behalf because I, an unquestioned US citizen with who was a leigt registered voter, had to vote via provisional ballot and come back the next day provide proof that I had moved 10 miles across town in order to have my vote counted.

But they file lawsuits to prevent people who cannot document that they are even US citizens be required to vote via a provisional ballot and return with proof of valid US citizenship.

ACLU arguing that Iowa can’t check votes? They’ve been taken over by radical leftists. The Left will try to take over everything. That’s how they operate. Trust me, I’ve been watching it happen for fifty years.

I suspect that the recent poll saying Harris was leading in Iowa was preemptive in anticipation of the amount of cheating the Dems are cooking up in Iowa City and DesMoines. Hopefully this decision will limit that and Trump will prevail throughout Iowa.

A group existed that had standing.
