Elections officials in Georgia have to certify results by the date required in state law, a judge ruled Monday, saying they have no discretion to delay certification because of fraud concerns or other potential issues that may arise as votes are being counted.
Fulton County Judge Robert McBurney wrote in an order Monday that "election superintendents in Georgia have a mandatory fixed obligation to certify election results" by Nov. 12.
The ruling came in a case filed by Julie Adams, a Republican member of the Fulton County election board, who argued election board members had leeway around certification. She wrote in her complaint that she would be "unable to fulfill her oath of office" if not empowered to investigate for fraud.
McBurney, who also presided over the Georgia grand jury that indicted Trump and others in 2023, wrote that "no election superintendent (or member of a board of elections and registration) may refuse to certify or abstain from certifying election results under any circumstance."
The case was supported by the Trump-aligned America First Policy Institute. During an Oct. 1 bench trial, Adams' attorneys argued that election officials should be allowed to certify results that don't include batches of ballots they're investigating for fraud.
McBurney said in his ruling that while local superintendents have an obligation to "investigate concerns about miscounts," they are not empowered to investigate or determine fraud. Instead, any concerns they have should be forwarded to law enforcement, he wrote.
"The Georgia Bureau of Investigation, the Secretary of State, the many District Attorneys, and the Attorney General are all better equipped and clearly authorized to undertake the work of verifying election fraud and seeking consequences for it. Superintendents are not," McBurney wrote.

Ridiculous. How can you certify a fraudulent election?
There must be a law against cheating. If not, why not cheat in every election. It cannot be stopped is what this judge just said.
Yes, this judge is on the take is some way. An accomplice, nothing more.
The law is the law.
So if they can’t delay certification, can they refuse to certify? if not, isn’t certification just an empty, meaningless gesture? The “results” are in, you have to certify (even if there are more votes than registered voters?)
If election officials have no discretion then they are merely tabulators.

There seems to be no other choice.
There are. But nobody ever has "standing" to enforce them.
No law can force someone to sign something they disagree with - it institutionalizes fraud and perjury.
So suddenly we want delays of weeks, or months, and no declared winner? After all the complaining about officials not being able to tally the vote in a timely manner?
Sorry, the law gives officials a week after election day to announce and certify results. If this were Dems trying to delay results and potentially miss the deadline for submitting Electoral ballots Freepers would be grabbing the torches and pitchforks.

They are going to ram the fraud through. We are not going to accept it. It will go to the Supreme Court if it has to. Hope team Trump has a protocol in place.

I think this judge will be overruled. Under penalty of perjury, they have to certify that the election results are accurate. The superintendants can say I can’t perjure myself so I won’t certify this election.

My thoughts exactly. It seems to be an unconstitutional ruling. Why certify if certification means nothing. Congress should not accept the Georgia electors under these conditions.
You don't. You use your authority to declare the election uncertifiable and throw it out.
Then it goes to the state legislature to select Electors to the Electoral College via their plenary power.
