TikTok turns to Supreme Court vets in case over potential US ban

TikTok and a group of creators on the popular short video app have tapped a pair of leading U.S. Supreme Court lawyers to battle the U.S. government over a law requiring China-based ByteDance to divest TikTok's U.S. assets or face a ban. Andrew Pincus of law firm Mayer Brown will argue against the controversial U.S. law for TikTok and ByteDance when the U.S. Court of Appeals for the D.C. Circuit hears arguments in their case on Sept 16. Jeffrey Fisher of Stanford Law School will advocate for content creators.

They will face longtime appellate lawyer Daniel Tenny of the Justice Department, which is defending the law. The Justice Department declined to comment, and TikTok did not immediately respond to a request for one. TikTok and ByteDance are also represented by a team from law firm Covington & Burling, including Alexander Berengaut, who is lead counsel for the companies and co-leader of the firm’s government litigation group.

The creators’ lawyers also include Ambika Kumar, co-leader of the media law practice at Davis Wright Tremaine. Fisher, who is a special counsel at law firm O’Melveny & Myers, has argued 48 cases at the Supreme Court and is widely known for his constitutional and criminal law work. Pincus has argued 30 cases at the high court, and he is known for his fights against class actions. The Justice Department’s Tenny has argued in major cases in federal appeals courts involving abortion rights, immigration and other matters.

The appeals court panel — Circuit Judges Sri Srinivasan, Neomi Rao and Douglas Ginsburg — will also hear from an attorney representing a nonprofit organization that also sued over the divest-or-ban law.

President Joe Biden signed the law in April, giving ByteDance until Jan. 19 to sell TikTok or face a ban.

US Gov’t wants to control social media because they know how strong it is at information operations on the population. Can’t let China do that to us...that’s the US gov’t job to control its people.

I remember back when we couldn’t buy any Red Chinese products. I don’t know if they were considered contraband or not, but you never saw any stuff in stores.

You should be more concerned that our government is attempting to censor free speech which is protected by the First Amendment, by the way.

TikTok is a hotbed a conservative creator content. And they don’t coordinate with the FBI and CIA. It’s worst crime is that it is kicking Zuckerberg’s ass across the board.
So he called his paid for congressfools and told them to do something.

The joke is that they say the ban is for “national security” and that it’s “bad for children”. This from a government who floods in millions of moslems and Venezuelans over an open border.. lets drag queens twerk in front of toddlers, protects the Epstein list, aborts and mutilates kids.

But yeah sure, it’s national security and protecting the kiddos.... the DC occupation government is worried sick about protecting America and the little tykes.

But I see a lot of MAGA content.
