VA Officials Tell Lawmakers They Won’t Comply With Proposed Laws to Preserve Veterans Gun Rights

U.S. Department of Veterans Affairs officials testified during a Wednesday House hearing that the department would not comply with proposed legislation barring it from sending certain information about U.S. military veterans to the federal government’s National Instant Criminal Background Check System (NICS).

The VA reasons that reliance on a fiduciary indicates a beneficiary is mentally incompetent. Federal law states firearms dealers receive a “deny message” if a NICS check for a potential buyer determines the buyer has been adjudicated as a mental defective.

Rep. Matt Rosendale (R-MT) challenged the VA witnesses later on in the hearing to explain their opposition to the Veterans Second Amendment Protection Act. …

VA Deputy Director of Pension and Fiduciary Service Kevin Friel denied that referring to veterans as mentally incompetent makes them less likely to want to seek the VA’s help …

“Is it the VA’s position that the VA will not comply with an act of Congress?” he asked.

“Yes sir. I guess, based off of what you have in testimony, yes sir,” Friel replied.

“That you would not comply?” Rosendale reiterated.

“Yes sir,” Friel said again.

“Well, I’m glad everybody hears that on the record—that the VA is going to refuse to comply regardless of what we actually pass here,” Rosendale said.

Minutes later in the hearing, Crane again pressed Friel to explain his thought process for deciding whether to follow the laws passed by Congress.

“The problem is we’re talking about veterans’ rights and due process and their right to bear and keep arms, another constitutional premise. But you, you’re willing to do what your boss [Biden] tells you to do, even if it violates their rights,” Crane said. “You should do some soul searching sir, you really should.”

Typical useless Republican rhetoric. This is not how you deal with some arrogant bureaucrat who has no regard for the law making authority of the representatives of the people. He is clearly stating his refusal to comply and needs to be fired. Not doing this sends a broader message to the rest of the bureaucracy that its OK to ignore laws.

A lot of this goes back to the VA (and other federal pension plans) not accepting power of attorney forms. If a parent wants his child to handle his finances for him, then the government requires the parent to be declared mentally incompetent to handle his own money and get doctors to sign off on it. For a while this was apparently pushed as a back door power of attorney, but it has all sorts of side effects like this.

I was starting the process for my father. My power of attorney forms was good for his banks, insurance companies and even selling his house, but I couldn't even change his address for his federal retirement. Funny thing is that it was changed when the post office informed them of his new address from me filling out and dropping off the change of address form in a USPS mailbox with no ID.

What would this proposed law actually do?
If this law would somehow deny a veteran the right to keep and bear arms without due process, then I would agree that the VA should refuse to comply with an unconstitutional law

the bill being prepared by Rep. Eli Crane (R-AZ), to be titled the “Safeguarding Veteran Second Amendment Rights Act.” The bill would bar the VA from joining in support of what are known as extreme risk protective orders or “Red Flag” laws, to seize a person’s firearms prior to a criminal conviction, if they are deemed to pose a risk to themselves or others.

The FBI, IRS, ATF and now the VA. I can’t believe WE pay those ahos. They’ll be wearing dark blue windbreakers with VA POLICE on the back and carrying guns. Now that the government agencies have gone full fascist, when is Mayorkass’s Department of Homie Security going to start reporting names of all the illegal aliens that it has allowed into the U.S. going to be reported to the National Instant Criminal Background Check System (NICS)?

It is the reverse of that. It is to bar the VA from sending information that means one thing to them, but another to NICS, which inappropriately causes veterans to be blocked from owning firearms.
