That argument has been made—and rejected by courts—for about as long as there has been an income tax.

Also, tips are specifically included by statute in “wages” taxed under FICA.

Tips are income and should be taxed.

I pay taxes on income. Most of the rest of us pay taxes income. Tips should be taxed.

Income tax paying voters should be pissed about this. I am.

Me too. I’m old enough to remember when Republicans opposed narrow tax breaks to favored constituencies. In fact, broadening, flattening, and lowering taxes was the whole point of the tax cut Trump signed.

Except if they pass it now and Biden signs it. They are just hoping the Dems will complain about the cost to the government.

That's what I was thinking. If the Dems allow this to pass Biden could sign it and take the issue away from President Trump and take credit for it himself.

They all make at least minimum wage. If they don’t make enough in tips to meet the minimum wage, the employer is required to make up the difference under FLSA.

Most make substantially more, or they would get a different job. There are plenty of non-tipped service industry jobs that pay better than minimum wage.

And if they make at or less than minimum wage, then they are already paying no taxes on their tips because of the standard deduction.

The only downside I see of this is if Cruz gets it passed, the Dems will take credit for it since it passed under Biden’s presidency. You know they will try to take credit...

Yes, note the column “Basic Combined Cash & Tip Minimum Wage Rate.” They have the same $7.25 minimum wage as everyone else. If they don’t make that much in combined tips and wages in a given week, the employer must make up the difference

With Trump, the thing is never the thing.

This is a wedge issue, aimed at a voter segment that the demoncrats depend on for votes.

Trump has steadily made inroads into the youth vote with NTFs, crypto, sneakercon, tips, etc.

He has made inroads into the black vote - particulary males.

Like the camel’s nose under the tent, it raises the issue of taxation as well.

Strategery, and I’m all for it.

Unfortunately, Rush isn’t here to explain it to reactionaries.

Tips are curently taxed. What spending reductions or offsetting taxes is Cruz proposing to offset the taxes lost by his proposal and avoid increaing the deficit and debt, or does Cruz merely what to boost his popularity and the debt and deficit don’t matter. Isn’t that how we’ve gotten to where we are. The Dims have no brake on spending and the GOP has no break on tax cuts, and operating together that way they amount to irresponsibility of both parties. The Dims GIVE the GOP their tax cuts and the GOP let’s the Dims increased spending go forward. That duoploy is against all of us.

I waited tables back when.

I got what I deserved, no more no less
and it wasn’t shared by a group.
