Former Attorney General Eric Holder said Wednesday he is concerned that the Supreme Court will come to a “dangerous” conclusion on former President Trump’s claim of presidential immunity, partly because it has taken time for the justices to reveal their decision.
Trump has made the immunity claim on charges related to the federal cases he faces on storing classified documents at his Mar-a-Lago home in Florida and related to the 2020 election and the Jan. 6 riot at the Capitol.

Trump made statements that the American people had to a right to hear. That is protected under Amendment I.
Trump’s use of “go wild” is the critical issue.
For younger folks it would meaning yelling, screaming, waving signs vigorously and other actions that are non-violent and non-destructive.

Article I, Section 3, Clause 7:
Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
President Trump was impeached but not convicted of the charge of insurrection. If he had been convicted he could have faced criminal prosecution. But this clause specifies when a president can be liable criminally: when he has been convicted by the Senate (requiring a 2/3 vote).
Apart from a conviction by the Senate, the president should constitutionally enjoy immunity from prosecution. This is how the Supreme Court should decide.
The president is unique in comparison to other offices from which a person might be removed by impeachment: The president has the power to pardon. He could even pardon himself. Couldn’t any presidents simply issue themselves a blanket pardon for any possible crimes they might have wittingly or unwittingly committed while in office?
