Texas Blocks Biden’s ATF Rule Restricting Gun Sales

The regulation would criminalize law-abiding Americans for private firearms transactions.

Texas has successfully blocked new restrictions on private gun sales imposed by the Biden administration’s Bureau of Alcohol, Tobacco, Firearms and Explosives.

A federal judge issued a preliminary injunction on Tuesday that halts enforcement of the regulations in Texas while litigation proceeds.

Attorney General Ken Paxton filed a lawsuit on May 1 challenging a new ATF rule that would redefine who is “engaged in the business” as a firearms dealer.

The 126-page Final Rule would have the effect of criminalizing law-abiding Americans for private gun purchases and sales.

Texas secured a temporary restraining order against the rule on May 19.

Tuesday’s ruling by U.S. District Judge Matthew Kacsmaryk blocks the Biden administration from enforcing the regulations against the plaintiffs in the case until their lawsuit is resolved.

Plaintiffs include Texas, Louisiana, Mississippi, Utah, Jeffrey Tormey, the Gun Owners of America, Inc., the Gun Owners Foundation, the Tennessee Firearms Association, and the Virginia Citizens Defense League.

The judge found that the ATF rule “eviscerates” the safe harbor provision contained in federal statute by asserting that a person’s “private collection” excludes firearms accumulated for personal protection.

Defendants maintain their interpretation despite acknowledging that “two-thirds of Americans report owning firearms primarily for ‘defense’ or ‘protection’” — thereby necessitating the absurdity that the statute’s safe harbor provision provides no safe harbor at all for the majority of gun owners.

Paxton applauded the ruling.

“Texas has secured an injunction against Biden’s unlawful ATF rule that would criminalize the private sale of guns. Biden’s unconstitutional rule cannot be enforced in Texas,” Paxton said in a statement. “I’m proud to fight and win for our Second Amendment rights.”

Another win for Texas's Attorney General Ken Paxton. He has been aggressive and effective in stopping Biden Administration's freedom stifling dictates. He would make a great attorney general in the future Trump Administration.

Does Texas have some F-16s, or do they just have a bunch of MAGA gun nuts? i mean we know how this works out. Just look at what happened in Afghanistan when some Jihadi gun nuts too on the whole of the US deparment of defense. How did that work out for them? Oh, wait, they’re running the country now- erase that.

One day their argument will be that whatever it is in dispute is not covered by “the right”, therefor there is no infringement.

How did that work out for them?

You are under the delusion that our military's ROE with US citizens would be as hands off as it was in Iraq and Afghanistan.

Having had relatives recently graduate from West Point and Annapolis, I assure you they've been trained to view US citizens as the enemy.

Santa Anna did come and take it. At the Alamo.

He then promptly got his ass kicked and entire army defeated in San Jacinto.

Think he lost his leg there, too.

Not sure if they got the cannon back, though. Good question.

Wouldn’t doubt that, but the ring-knockers still have to get the grunts to carry out their orders.

How many grunts from East Texas are gonna be eager to round up mom and dad and all of the cousins and put them in camps?

Probably not many, which is why they’re probably going try to enlist a bunch of “new citizen” border crossers in a right hurry as the next step.

About 2/3 of enlisted in the services identify as moderate to liberal. Take a look at how many immigrants are enlisting.

A few guys, like me, with AR-15's will not stand the impact of a hellfire from an Apache that they never see or hear.
