77-Year-Old Oakland Homeowner Fatally Shoots Burglary Suspect, Gets Arrested

In Oakland, California, a startling incident unfolded as a 77-year-old homeowner found himself at the center of a controversial arrest after fatally shooting a robbery suspect. The homeowner, whose identity remains undisclosed, was taken into custody under suspicion of murder following the tragic event that transpired at 98th Avenue and Burr Street in East Oakland on Monday evening.

Reports indicate that the homeowner encountered a harrowing situation when two men and a woman arrived at his property in a stolen Infiniti Q40. Eyewitnesses recall observing the trio trespass onto the premises, with one of the men wielding a crowbar. Self-defense and use of deadly force laws are complex and open to a lot of interpretation by a jury or judge.

Usually, there must be a determination that if you have a firearm, that the attacker could inflict deadly force and you were afraid for your life. Yes, the guy was 77, but how would the guy with the tire iron be portrayed to the jury? Was the 77 year old a “gun nut” who loads his own ammo, practices regularly shoot at “human-style” paper targets and was spoiling to kill someone? An evil prosecutor can imply a lot of things.

Then in most jurisdictions there is the question of what would a “reasonable man” have done in the same situation. Unfortunately in liberal areas, a “reasonable man” might be required to call the police (even if they have long response times) and retreat.

In the concealed carry courses I have had, if you need to use your personal concealed carry weapon, you should plan on going to jail, have the contact information for a good attorney familiar with local gun laws in your wallet, and be certain, that your life (or someone you care about’s life was in immediate danger.)

My neighbors would notice. Then they would blackmail me non-stop for free tomatoes.

There are other options. We all know how precious your tomatos are.

Buy a dehydrator and start making home made doggy treas.

It could be a profitable home business.

In that neighborhood, known for heavy drug trafficking and violence, it would be pretty easy to know where things are headed when your home is approached by three thieves and crowbar. Unfortunately, in Oakland, police response time, once measured with a watch, is now measured by a calendar. Yet, the democrat-soros stranglehold of the city openly displays its contempt for self defense by citizens. It’s also interesting that the city can muster cops to arrest such a citizen, while seemingly unable to respond to actual crimes.

I have an original Python made in the 70s. 4 inch barrel, electroless nickel plated. Near 100% condition with the original box and the sales receipt. I had it appraised at nearly $4,000.

The gunshot was not the onset but the the end to the alarming events, unless you count the arrest of the homeowner as alarming. Which I do.

The problem he has is that he apparently shot the hood while he was still outside the residence, and may have been still on the fence he hopped to get in the yard. Then, wisely in my estimation, he refused to give police a statement about the shooting.

When a shooter won’t talk to the police after killing someone in the yard, somebody is getting arrested.
