Are you really confident that the NY judiciary would put a stop to it if it was done by the top Democrat?
The New York Judiciary wouldn’t have to do anything as the hypothetical Biden commutation would be void ab initio.
Biden cannot pardon Trump under any circumstances.
But Biden and the DNC can pressure New York Governor Hochul to pardon Trump. I don’t see that happening.
But who knows? If the Deep State decides that pardoning Trump will help the Democrats, Hochul will do it.

It wouldn’t be the NY judiciary putting a stop to it. There is simply no legal way for anyone other than the governor to issue a pardon or clemency in the state cases, no matter what a president or anyone else may want.
